Section
1.
Section
321.453,
Code
2017,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
3.
A
motor
vehicle
that
is
operated
by
a
3
farmer
and
that
is
carrying
an
implement
of
husbandry
between
4
fields,
locations
for
repair,
or
locations
for
storage
of
the
5
implement
of
husbandry
shall
be
exempt
from
any
requirement
to
6
obtain
a
permit
under
section
321.463,
321.471,
or
321.474.

Nothing
in
this
subsection
shall
be
construed
to
exempt
such
8
a
vehicle
from
any
requirement
or
restriction
other
than
a
9
requirement
to
obtain
a
permit,
including
but
not
limited
to
10
requirements
or
restrictions
relating
to
size,
weight,
load,
11
lighting,
flags,
equipment,
or
manner
of
operation.
For
the
12
purposes
of
this
subsection,
“farmer”
means
as
defined
in
13
section
142D.2.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
16
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Code
section
321.453
exempts
certain
motor
vehicles
and
18
equipment
from
the
provisions
of
Code
chapter
321
(motor
19
vehicles
and
law
of
the
road)
governing
size,
weight,
and
load,
20
and
the
permit
requirements
of
Code
chapter
321E
(vehicles
of
21
excessive
size
and
weight).
Such
motor
vehicles
and
equipment
22
include
fire
apparatus,
certain
road
maintenance
equipment,
23
implements
of
husbandry
when
moved
or
moving
upon
a
highway
24
that
is
not
a
portion
of
the
interstate,
and
certain
equipment
25
used
primarily
for
construction
of
permanent
conservation
26
practices
on
agricultural
land.
However,
such
motor
vehicles
27
and
equipment
are
not
exempt
from
the
provisions
of
Code
28
section
321.463
(maximum
gross
weight),
321.471
(restrictions
29
by
local
authorities),
or
321.474
(restrictions
by
the
30
department
of
transportation),
which
include
certain
permitting
31
provisions.

This
bill
provides
that
a
motor
vehicle
that
is
operated
by
33
a
farmer
and
that
is
carrying
an
implement
of
husbandry
between

fields,
locations
for
repair,
or
locations
for
storage
of
the
