S.F. 346 Section 1. Section 260C.14, Code 2017, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 25. a. Waive tuition and mandatory fees 3 for a child of a disabled veteran of the United States armed 4 services or the Iowa national guard if all of the following 5 conditions are met: 6 (1) The child is an unmarried resident of the state who 7 is no more than twenty-seven years old or, if the child is 8 a veteran as defined in section 35.1, no more than thirty 9 years old, and whose annual income, including the value of any 10 support received from a parent, does not exceed the national 11 poverty level. A child who is an adopted child or a stepchild 12 of a disabled veteran must have entered into such status 13 prior to the child’s twenty-fourth birthday. As used in this 14 subsection, “national poverty level” is the poverty threshold 15 for one person, as most recently calculated by the United 16 States census bureau. 17 (2) The child is the natural or adopted child or stepchild 18 of a veteran who meets any of the following criteria: 19 (a) At the time of entry into the armed services of the 20 United States was a resident of this state, and who was 21 subsequently determined by the United States government to be 22 totally and permanently disabled due to a service-connected 23 disability or whose death was officially rated as 24 service-connected as certified by the United States department 25 of veterans affairs and, if discharged, was discharged under 26 honorable conditions. 27 (b) At the time of entry into state active duty or national 28 guard duty as defined in section 29A.1, was a resident of this 29 state and was subsequently determined by the United States 30 government to be totally and permanently disabled due to a 31 service-connected disability or whose death was officially 32 rated as service-connected as certified by the United States 33 department of veterans affairs and, if discharged, was 34 discharged under honorable conditions. 35 -1- LSB 2199SS (4) 87 kh/nh 1/ 4
S.F. 346 (3) The event which caused the veteran to be determined to 1 be totally and permanently disabled due to a service-connected 2 disability or which resulted in the veteran’s death being rated 3 as service-connected occurred prior to the child’s twenty-first 4 birthday. 5 b. The department of veterans affairs shall determine the 6 eligibility of any applicant for a tuition and fee waiver under 7 this subsection. 8 c. Tuition and mandatory fees for prior years of enrollment 9 shall not be waived under this subsection. 10 Sec. 2. Section 262.9, Code 2017, is amended by adding the 11 following new subsection: 12 NEW SUBSECTION . 39. a. Direct the institutions of higher 13 learning governed by the board to waive tuition and mandatory 14 fees for a child of a disabled veteran of the United States 15 armed forces or the Iowa national guard if all of the following 16 conditions are met: 17 (1) The child is an unmarried resident of the state who 18 is no more than twenty-seven years old or, if the child is 19 a veteran as defined in section 35.1, no more than thirty 20 years old, and whose annual income, including the value of any 21 support received from a parent, does not exceed the national 22 poverty level. A child who is an adopted child or a stepchild 23 of a disabled veteran must have entered into such status 24 prior to the child’s twenty-fourth birthday. S.F. 346 service-connected as certified by the United States department 1 of veterans affairs and, if discharged, was discharged under 2 honorable conditions. 3 (b) At the time of entry into state active duty or national 4 guard duty as defined in section 29A.1, was a resident of this 5 state and was subsequently determined by the United States 6 government to be totally and permanently disabled due to a 7 service-connected disability or whose death was officially 8 rated as service-connected as certified by the United States 9 department of veterans affairs and, if discharged, was 10 discharged under honorable conditions. 11 (3) The event which caused the veteran to be determined to 12 be totally and permanently disabled due to a service-connected 13 disability or which resulted in the veteran’s death being rated 14 as service-connected occurred prior to the child’s twenty-first 15 birthday. 16 b. The department of veterans affairs shall determine the 17 eligibility of any applicant for a tuition and fee waiver under 18 this subsection. 19 c. Tuition and mandatory fees for prior years of enrollment 20 shall not be waived under this subsection. 21 Sec. 3. IMPLEMENTATION OF ACT. Section 25B.2, subsection 22 3, shall not apply to this Act. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill directs that the tuition and mandatory fees at the 27 community colleges and regents universities be waived for the 28 children of veterans with service-connected disabilities. 29 The natural or adopted child or stepchild of a 30 service-disabled veteran must be an unmarried resident of the 31 state who is no more than 27 years old, or 30 if the child is 32 a veteran; and must have an annual income, including parental 33 support, that does not exceed the national poverty level. S.F. 346 prior to the child’s 24th birthday. 1 At the time of entry into the United States armed services, 2 state active duty, or national guard duty, the veteran must 3 have been a resident of this state who was subsequently 4 determined by the United States government to be totally and 5 permanently disabled due to a service-connected disability 6 or whose death was officially rated as service-connected as 7 certified by the United States department of veterans affairs 8 and, if discharged, was discharged under honorable conditions. 9 The event which caused the veteran’s total and permanent 10 service-connected disability or death must have occurred prior 11 to the child’s 21st birthday. 12 The department of veterans affairs shall determine the 13 eligibility of any applicant for a tuition and fee waiver. 14 The waiver cannot be retroactively applied for coursework 15 completed. 16 The bill may include a state mandate as defined in Code 17 section 25B.3. The bill makes inapplicable Code section 25B.2, 18 subsection 3, which would relieve a political subdivision from 19 complying with a state mandate if funding for the cost of 20 the state mandate is not provided or specified. Therefore, 21 political subdivisions are required to comply with any state 22 mandate included in the bill. 23 -4- LSB 2199SS (4) 87 kh/nh 4/ 4
