Section
1.
Section
321.323A,
Code
2017,
is
amended
by
adding
1
the
following
new
subsection:
2
NEW
SUBSECTION
.
2A.
The
operator
of
a
motor
vehicle
3
approaching
a
stationary
garbage
or
recycling
collection
4
vehicle
shall
approach
the
vehicle
with
due
caution
and
shall
5
proceed
in
one
of
the
following
manners,
absent
any
other
6
direction
by
a
peace
officer:
7
a.
Make
a
lane
change
into
a
lane
not
adjacent
to
the
8
garbage
or
recycling
collection
vehicle
if
possible
in
the
9
existing
safety
and
traffic
conditions.
10
b.
If
a
lane
change
under
paragraph
“a”
would
be
impossible,
11
prohibited
by
law,
or
unsafe,
reduce
the
speed
of
the
motor
12
vehicle
to
a
reasonable
and
proper
speed
for
the
existing
road
13
and
traffic
conditions,
which
speed
shall
be
less
than
the
14
posted
speed
limit,
and
be
prepared
to
stop.

EXPLANATION
16
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
17
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
operator
of
a
motor
vehicle
19
approaching
a
stationary
garbage
or
recycling
collection
20
vehicle
to
approach
the
vehicle
with
due
caution
and
to
make
21
a
lane
change
into
a
lane
not
adjacent
to
the
garbage
or
22
recycling
collection
vehicle
if
possible
in
the
existing
23
safety
and
traffic
conditions,
or
if
a
lane
change
would
be
24
impossible,
prohibited
by
law,
or
unsafe,
reduce
the
speed
25
of
the
vehicle
to
a
reasonable
and
proper
speed
for
the
26
existing
road
and
traffic
conditions,
which
speed
must
be
27
less
than
the
posted
speed
limit,
and
be
prepared
to
stop.

These
requirements
exist
under
current
law
for
motor
vehicles
29
approaching
stationary
authorized
emergency
vehicles,
towing
30
or
recovery
vehicles,
utility
maintenance
vehicles,
municipal
31
maintenance
vehicles,
and
highway
maintenance
vehicles.
32
A
violation
of
the
bill
is
punishable
by
a
scheduled
fine
of
33
$100.
In
addition,
a
person
convicted
of
a
violation
resulting
34
in
an
accident
causing
property
damage
may
be
subject
to
the
35

suspension
of
the
person’s
driver’s
license
for
90
days.
A
1
person
convicted
of
a
violation
resulting
in
an
accident
2
causing
bodily
injury
to
another
person
may
be
subject
to
a
3
fine
of
$500
and
suspension
of
the
person’s
driver’s
license
4
for
180
days.
A
person
convicted
of
a
violation
resulting
in
5
an
accident
causing
the
death
of
another
person
may
be
subject
6
to
a
fine
of
$1,000
and
suspension
of
the
person’s
driver’s
7
license
for
one
year.
