1.
Section
262.9,
subsection
17,
Code
2017,
is

amended
by
adding
the
following
new
paragraph:

PARAGRAPH
.
c.
Adopt
rules
establishing
that
for
an
3
individual
to
be
classified
as
a
resident
for
purposes
of
4
in-state
tuition
and
mandatory
fees,
the
individual,
except
as
5
otherwise
provided
under
this
subsection,
shall
have
resided
in
6
this
state
for
at
least
thirty
consecutive
months
immediately
7
prior
to
enrollment
in
an
institution
of
higher
learning
8
governed
by
the
board.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
directs
the
state
board
of
regents
to
adopt
rules
13
to
establish
that
for
an
individual
to
be
classified
as
a
14
resident
for
purposes
of
in-state
tuition
and
mandatory
fees,
15
the
individual
must
have
resided
in
Iowa
for
30
consecutive
16
months
immediately
prior
to
their
enrollment
in
a
regents
17
university.
18
Currently,
the
board
may,
at
its
discretion,
adopt
rules
19
relating
to
the
residency
of
students,
for
fee
purposes,
who
20
are
also
residents
of
Iowa’s
sister
states.
The
board
is
21
directed
to
adopt
rules
to
classify
as
residents,
for
purposes
22
of
undergraduate
tuition
and
mandatory
fees,
qualified
veterans
23
and
qualified
military
persons
and
their
spouses
and
dependent
24
children
who
are
domiciled
in
this
state
while
enrolled
in
a
25
regents
university.
These
current
statutory
provisions
are
26
exempted
from
the
residency
requirement
established
by
the
27
bill.
