S.F. 330 Section 1. Section 282.18, subsection 8, Code 2017, is 1 amended to read as follows: 2 8. If a request filed under this section is for a child 3 requiring special education under chapter 256B , the request to 4 transfer to the other district shall only be granted if the 5 receiving district maintains a special education instructional 6 program which is appropriate to meet the child’s educational 7 needs and the enrollment of the child in the receiving 8 district’s program would not cause the size of the class in 9 that special education instructional program in the receiving 10 district to exceed the maximum class size in rules adopted by 11 the state board of education for that program. For children 12 requiring special education, the board of directors of the 13 district of residence shall promptly provide all reasonable 14 assistance in completing forms necessary in order for the 15 receiving district to receive medical assistance reimbursement 16 for services the receiving district provides in accordance 17 with the student’s individualized education program, and shall 18 pay to the receiving district the actual costs incurred in 19 providing the appropriate special education. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill requires the school district of residence to 24 promptly assist the receiving district in completing Medicaid 25 reimbursement forms that the receiving district must submit in 26 order to receive reimbursement for special education services 27 that it provides to a child who requires special education and 28 is participating in open enrollment. 29 -1- LSB 2610XS (2) 87 kh/nh 1/ 1
