Section
321I.10,
subsection
5,
Code
2017,
is

amended
to
read
as
follows:

5.
a.
The
state
department
of
transportation
may
issue
3
a
permit
to
a
state
agency,
a
county,
or
a
city
to
allow
an
4
all-terrain
vehicle
trail
to
cross
a
primary
highway.
The
5
trail
crossing
shall
be
part
of
an
all-terrain
vehicle
trail
6
designated
by
the
state
agency,
county,
or
city.
A
city
7
street
that
has
been
designated
by
a
city
for
the
operation
of
8
registered
all-terrain
vehicles
shall
be
considered
to
be
an
9
all-terrain
vehicle
trail
for
the
purposes
of
this
subsection.

A
county
roadway
that
has
been
designated
by
a
county
for
11
the
operation
of
registered
all-terrain
vehicles
shall
be
12
considered
to
be
an
all-terrain
vehicle
trail
for
the
purposes
13
of
this
subsection.
A
permit
shall
be
issued
pursuant
to
14
this
subsection
only
if
the
crossing
can
be
accomplished
in
a
15
safe
manner
and
allows
for
adequate
sight
distance
for
both
16
motorists
and
all-terrain
vehicle
operators.

b.
Notwithstanding
paragraph
“a”
,
the
state
department
of
18
transportation
shall
issue
a
permit
to
allow
an
all-terrain
19
vehicle
trail
to
cross
a
primary
highway
if
the
intersection
20
of
the
trail
and
the
highway
is
regulated
by
an
official
21
traffic-control
signal
as
defined
in
section
321.1
upon
the
22
request
of
a
state
agency,
a
county,
or
a
city.
23
c.
The
state
department
of
transportation
may
adopt
rules
24
to
administer
this
subsection
.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
permits
issued
by
the
department
of

transportation
to
allow
all-terrain
vehicle
trails
to
cross
30
primary
highways.

The
bill
provides
that
a
city
street
or
a
county
roadway
that
32
has
been
designated
by
the
city
or
county
for
the
operation
of
33
all-terrain
vehicles
shall
be
considered
an
all-terrain
vehicle
34
trail
for
the
purposes
of
issuing
such
permits.

The
bill
requires
the
department
of
transportation
to

the

the
trail
and
the

is
regulated

an
official
traffic-control
signal
as

defined
in
Code
section
321.1.
Code
section
321.1(47)
defines
5
“official
traffic-control
signal”
as
any
device,
whether
6
manually,
electrically,
or
mechanically
operated,
by
which
7
traffic
is
alternately
directed
to
stop
and
to
proceed.
