Section
1.
FEDERAL
HEALTH
CARE
REFORM
MEASURES
——

PROHIBITION
OF
FUNDING
FOR
ABORTIONS.

1.
The
use
of
funds
appropriated
under
or
appropriated
3
to
any
trust
fund
pursuant
to
the
federal
Patient
Protection
4
and
Affordable
Care
Act,
the
federal
Health
Care
and
Education
5
Reconciliation
Act
of
2010,
or
any
successor
legislation,
shall
6
be
restricted
in
this
state
as
follows:
7
a.
Such
funds
shall
not
be
expended
for
any
abortion
in
this
8
state.
9
b.
Such
funds
shall
not
be
expended
for
health
insurance
10
coverage,
health
benefits,
or
health
services
that
include
11
coverage
for
abortion,
provided
through
a
contract
or
other
12
arrangement
with
a
carrier
as
defined
in
section
513B.2.
13
2.
The
restrictions
of
this
section
shall
not
apply
to
the
14
use
of
such
funds
for
an
abortion
if
the
woman
suffers
from
15
a
physical
disorder,
physical
injury,
or
physical
illness,
16
including
a
life-endangering
physical
condition
caused
by
or
17
arising
from
the
pregnancy
itself,
that
would,
as
certified
18
by
a
physician,
place
the
woman
in
danger
of
death
unless
an
19
abortion
is
performed.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
21
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
23
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
24
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
restricts
the
use
of
funds
appropriated
under
26
or
appropriated
to
any
trust
fund
pursuant
to
federal
health
27
care
reform
legislation
for
use
in
this
state,
by
prohibiting
28
expenditure
of
such
funds
for
an
abortion
in
the
state
and
for
29
health
insurance
coverage,
health
benefits,
or
health
services
30
that
include
coverage
for
abortion,
provided
by
a
carrier.
The
31
restrictions
do
not
apply,
however,
if
the
woman
suffers
from
32
a
physical
disorder,
physical
injury,
or
physical
illness,
33
including
a
life-endangering
physical
condition
caused
by
or

arising
from
the
