NEW SECTION . 147.85A Inquiry about firearm 1 ownership or possession prohibited. 2 A person licensed to practice a profession under this 3 chapter shall not inquire about or otherwise request 4 information about a patient’s or client’s ownership or 5 possession of firearms. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 This bill prohibits a person licensed under Code chapter 147 10 (health-related professions) from inquiring about or otherwise 11 requesting information about a patient’s or client’s ownership 12 or possession of firearms. A person violating the bill is 13 guilty of a serious misdemeanor. A serious misdemeanor is 14 punishable by confinement for no more than one year and a fine 15 of at least $315 but not more than $1,875. 16 A person licensed under Code chapter 147 includes a 17 physician and surgeon, podiatric physician, osteopathic 18 physician and surgeon, physician assistant, psychologist, 19 chiropractor, nurse, dentist, dental hygienist, dental 20 assistant, optometrist, speech pathologist, audiologist, 21 pharmacist, physical therapist, physical therapist assistant, 22 occupational therapist, occupational therapy assistant, 23 orthotist, prosthetist, pedorthist, respiratory care 24 practitioner, practitioner of cosmetology arts and sciences, 25 practitioner of barbering, funeral director, dietitian, marital 26 and family therapist, mental health counselor, respiratory 27 care and polysomnography practitioner, polysomnographic 28 technologist, social worker, massage therapist, athletic 29 trainer, acupuncturist, nursing home administrator, hearing aid 30 specialist, or sign language interpreter or transliterator. 31 -1- LSB 1017XS (4) 87 tr/rh/nh 1/ 1
