S.F. 2387 Section 1. PROVISIONAL REGIONALIZATION AUTHORIZATION. 1 1. During the time period beginning on the effective 2 date of this Act and ending June 30, 2019, upon receiving an 3 application from Sioux and Plymouth counties, the director of 4 human services may authorize the counties to form and operate a 5 mental health and disability services region on a provisional 6 basis for up to twelve months in accordance with this section. 7 2. Unless the director grants an exception to policy 8 allowing the counties and their region, during the provisional 9 operation time period, to meet a requirement through an 10 alternative means, the counties and their region shall comply 11 with all of the requirements applicable to a mental health and 12 disability services region under chapter 331 and any other 13 law applicable to regions including but not limited to the 14 exemption provisions in 331 IAC 25.91. 15 3. If the director determines the two counties and their 16 region are not in compliance with the requirements under 17 subsection 2 during the provisional operation time period and 18 that compliance will not be achieved through a corrective 19 action plan, the director may assign each county to a region 20 contiguous to the county. The region assigned shall amend its 21 chapter 28E agreement and other operating requirements and 22 policies to accept the assigned county. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill provides that the director of the department 27 of human services may authorize Sioux and Plymouth counties 28 to form and operate a mental health and disability services 29 (MHDS) region for 12 months on a provisional basis. Unless 30 the director grants an exception to policy, authorizing the 31 counties to meet a requirement through an alternative means, 32 the counties are required to comply with all requirements 33 applicable to an MHDS region under Code chapter 331 and other 34 law applicable.
