Section
1.
Section
257.6,
subsection
1,
paragraph
a,
Code
1
2018,
is
amended
by
adding
the
following
new
subparagraph:

.
(8)
Pupils
who
are
enrolled
in
public

schools
within
the
district
under
section
282.1,
subsection
4
3,
in
grades
kindergarten
through
twelve
and
including
5
prekindergarten
pupils
enrolled
in
special
education
programs.

2.
Section
282.1,
subsection
2,
Code
2018,
is
amended
7
to
read
as
follows:

2.
For
purposes
of
this
section
,
“resident”
means
a
child
9
who
is
meets
either
of
the
following
requirements:
10
a.
Is
physically
present
in
a
district,
whose
residence
has
11
not
been
established
in
another
district
by
operation
of
law,
12
and
who
meets
any
of
the
following
conditions:
13
a.
(1)
Is
in
the
district
for
the
purpose
of
making
a
home
14
and
not
solely
for
school
purposes.
15
b.
(2)
Meets
the
definitional
requirements
of
the
term
16
“homeless
individual”
under
42
U.S.C.
§11302(a)
and
(c).
17
c.
(3)
Lives
in
a
juvenile
detention
center
or
residential
18
facility
in
the
district.
19
b.
Is
domiciled
with
the
child’s
parent
or
guardian
who
is
20
on
active
duty
in
the
military
service
of
the
United
States
and
21
is
stationed
and
domiciled
at
a
federal
military
installation
22
located
in
an
out-of-state
county
that
is
contiguous
to
a
23
county
in
this
state.

3.
Section
282.1,
Code
2018,
is
amended
by
adding
the
25
following
new
subsections:

SUBSECTION
.
3.
The
parent
or
guardian
of
a
child
27
who
meets
the
requirements
of
subsection
2,
paragraph
“b”
,
28
paragraph
may
enroll
the
child
in
a
school
district
in
a
county
29
in
this
state
that
is
contiguous
to
the
out-of-state
county
in
30
which
the
military
installation
is
located.
Notwithstanding
31
section
285.1
relating
to
transportation
of
resident
pupils,
32
the
parent
or
guardian
is
responsible
for
transporting
the
33
child
without
reimbursement
to
and
from
a
point
on
a
regular
34
school
bus
route
of
the
district
of
enrollment.

4.
Notwithstanding
section
282.6,
if
a
1
parent
or
guardian
enrolls
a
child
in
a
school
district
in
2
accordance
with
subsection
3,
the
school
district
shall
be
free
3
of
tuition
for
such
child.

EXPLANATION
5
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
6
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
a
child
who
lives
with
the
child’s
8
parent
or
guardian
who
is
on
active
duty
in
the
military
9
service
of
the
United
States
and
is
stationed
and
domiciled
at
10
certain
federal
military
installations
is
considered
a
resident
11
of
the
state
and
may
enroll
in
a
school
district
in
this
state,
12
free
of
tuition,
that
is
located
in
a
county
contiguous
to
the
13
county
in
which
the
military
installation
is
located.
A
school
14
district
shall
count
the
pupil
in
its
actual
enrollment
count
15
for
purposes
of
calculating
state
foundation
aid.
The
parent
16
or
guardian
is
responsible
for
transporting
the
child
without
17
reimbursement
to
and
from
a
point
on
a
regular
school
bus
route
18
of
the
district
of
enrollment.
19
The
bill
makes
conforming
changes.
