Section
1.
Section
260C.14,
Code
2018,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
25.
Identify
the
courses
that
will
utilize
3
open
educational
resources
where
the
community
college
provides
4
information
or
mechanisms
for
course
registration,
which
5
may
be
on
the
internet.
For
purposes
of
this
section,
“open
6
educational
resources”
means
materials
used
to
support
education
7
that
are
in
the
public
domain
or
are
under
an
open
license
and
8
that
may
be
freely
accessed,
reused,
modified,
and
shared,
9
including
but
not
limited
to
instructional
materials,
tests,
10
course
syllabi,
and
textbooks.

Sec.
2.
Section
261.2,
subsection
11,
Code
2018,
is
amended
12
to
read
as
follows:

11.
Require
any
postsecondary
institution
whose
students
14
are
eligible
for
or
who
receive
financial
assistance
under
15
programs
administered
by
the
commission
to
transmit
do
all
of
16
the
following:
17
a.
Transmit
annually
to
the
commission
information
about
the
18
numbers
of
minority
students
enrolled
in
and
minority
faculty
19
members
employed
at
the
institution.
The
commission
shall
20
compile
and
report
the
information
collected
to
the
general
21
assembly,
the
governor,
and
the
legislative
services
agency
by
22
March
1
annually.
23
b.
Identify
the
courses
that
will
utilize
open
educational
24
resources,
as
defined
in
section
260C.14,
subsection
25,
where
25
the
institution
provides
information
or
mechanisms
for
course
26
registration,
which
may
be
on
the
internet.

Sec.
3.
Section
262.9,
Code
2018,
is
amended
by
adding
the
28
following
new
subsection:

NEW
SUBSECTION
.
39.
Direct
each
institution
of
higher
30
learning
under
its
control
to
identify
the
courses
that
will
31
utilize
open
educational
resources,
as
defined
in
section
32
260C.14,
subsection
25,
where
the
institution
provides
33
information
or
mechanisms
for
course
registration,
which
may
be
34
on
the
internet.
In
addition,
each
institution
shall
develop
35

implement,
upon
receiving
board
approval,
a
five-year
plan
1
to
increase
the
number
of
courses
utilizing
open
educational
2
resources.
The
plan
shall
include
metrics
and
goals
for
the

percentage
of
courses
that
utilize
open
educational
resources.

Prior
to
approving
a
plan
under
this
subsection,
the
board
5
shall
determine
whether
the
plan
is
sustainable
beyond
the
6
initial
five-year
implementation
and
whether
the
plan
will
7
effectively
reduce
students’
textbook
and
instructional
8
materials
costs.

the
members
of
the
general
assembly.

This
bill
establishes
requirements
relating
to
the
use
13
and
identification
of
open
educational
resources
by
Iowa’s
14
postsecondary
institutions.
15
Community
colleges,
postsecondary
institutions
whose
16
students
receive
financial
assistance
administered
by
the
17
college
student
aid
commission,
and
regents
universities
18
are
directed
to
identify
the
courses
that
will
utilize
19
open
educational
resources,
where
the
institution
provides
20
information
on
mechanisms
for
course
registration,
which
may
21
be
on
the
internet.
Open
educational
resources
are
defined
22
as
materials
used
to
support
education
that
are
in
the
public
23
domain
or
are
under
an
open
license
and
that
may
be
freely
24
accessed,
reused,
modified,
and
shared,
including
but
not
25
limited
to
instructional
materials,
tests,
course
syllabi,
and
26
textbooks.

In
addition,
regents
universities
must
develop
and
28
implement,
upon
receiving
state
board
of
regents
approval,
a
29
five-year
plan
to
increase
the
number
of
courses
utilizing
open
30
educational
materials.
