S.F. 2343 Section 1. Section 321.279, Code 2018, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4. Notwithstanding any other provision 3 of law to the contrary, a law enforcement agency may retain 4 possession of a motor vehicle suspected to have been 5 operated by a person in violation of this section until final 6 disposition of any criminal proceeding related to the violation 7 if the person was a registered owner of the vehicle at the time 8 of the suspected violation. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill permits a law enforcement agency to retain 13 possession of a vehicle suspected to have been operated by a 14 person eluding or attempting to elude a law enforcement vehicle 15 until final disposition of any criminal proceeding related 16 to the violation if the person was a registered owner of the 17 vehicle at the time of the suspected violation. 18 -1- LSB 2387SV (3) 87 ns/rh 1/ 1
