S.F. 2342 Section 1. Section 17A.23, Code 2018, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4. An agency shall not implement or enforce 3 any standard, requirement, or threshold, including any term 4 or condition of a license issued by the agency, unless that 5 standard, requirement, or threshold is explicitly required or 6 explicitly permitted by a state statute, rule adopted pursuant 7 to this chapter, or a federal statute or regulation. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill modifies Code chapter 17A, the Iowa administrative 12 procedure Act, by prohibiting a state agency from implementing 13 or enforcing any standard, requirement, or threshold, including 14 any term or condition of a license issued by the agency, 15 unless that standard, requirement, or threshold is explicitly 16 required or explicitly permitted by a state statute, rule 17 adopted pursuant to Code chapter 17A, or a federal statute or 18 regulation. 19 -1- LSB 5734SV (2) 87 je/rj 1/ 1
