S.F. 2315 Section 1. Section 282.18, subsection 7, Code 2018, is 1 amended to read as follows: 2 7. a. A pupil participating in open enrollment shall be 3 counted, for state school foundation aid purposes, in the 4 pupil’s district of residence. A pupil’s residence, for 5 purposes of this section , means a residence under section 6 282.1 . The board of directors of the district of residence 7 shall pay to the receiving district an amount equal to the sum 8 of the state cost following: 9 (1) The regular program foundation base per pupil for the 10 previous school fiscal year plus either minus the amount per 11 pupil of foundation property tax in the district of residence 12 for the previous fiscal year. 13 (2) Either the teacher leadership supplement state district 14 cost per pupil for the previous fiscal year as provided in 15 section 257.9 257.10 or the teacher leadership supplement 16 foundation aid for the previous fiscal year as provided in 17 section 284.13, subsection 1 , paragraph “d” , if both the 18 district of residence and the receiving district are receiving 19 such supplements , plus any . 20 (3) The teacher salary supplement district cost per pupil 21 for the previous fiscal year for the district of residence. 22 (4) The professional development supplement district cost 23 per pupil for the previous fiscal year for the district of 24 residence. 25 (5) The early intervention supplement district cost 26 per pupil for the previous fiscal year for the district of 27 residence. 28 (6) The area education agency teacher salary supplement 29 district cost per pupil for the previous fiscal year for the 30 district of residence. 31 (7) The area education agency professional development 32 supplement district cost per pupil for the previous fiscal year 33 for the district of residence. 34 (8) The special education support services foundation 35 -1- LSB 5830XS (2) 87 md/jh 1/ 3
S.F. 2315 base per pupil for the previous fiscal year multiplied by the 1 pupil’s special education weighted enrollment for the previous 2 fiscal year. 3 (9) Any moneys received for the pupil as a result of the 4 non-English speaking weighting under section 280.4, subsection 5 3 , for the previous school year multiplied by the regular 6 program state cost per pupil for the previous fiscal year. 7 (10) The amount of any per pupil federal funding received by 8 the district of residence as the result of the pupil. 9 b. If the pupil participating in open enrollment is also 10 an eligible pupil under section 261E.6 , the receiving district 11 shall , in addition to the amount paid under paragraph “a” , pay 12 the tuition reimbursement amount to an eligible postsecondary 13 institution as provided in section 261E.7 . 14 Sec. 2. APPLICABILITY. This Act applies to school budget 15 years beginning on or after July 1, 2019. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 Current Code section 282.18(7) provides that a pupil 20 participating in open enrollment shall be counted, for state 21 school foundation aid purposes, in the pupil’s district of 22 residence. The school district of residence then is required 23 to pay to the receiving district the sum of the state cost per 24 pupil for the previous school year plus either the teacher 25 leadership supplement state cost per pupil for the previous 26 fiscal year or the teacher leadership supplement foundation aid 27 for the previous fiscal year if both the district of residence 28 and the receiving district are receiving such supplements, 29 plus any moneys received for the pupil as a result of the 30 non-English speaking weighting and any eligible postsecondary 31 tuition reimbursement amounts under Code section 261E.7, if 32 applicable. 33 This bill modifies the amount required to be paid from 34 the district of residence to the receiving district to be 35 -2- LSB 5830XS (2) 87 md/jh 2/ 3
S.F. 2315 an amount equal to the following: (1) the regular program 1 foundation base per pupil for the previous fiscal year minus 2 the amount per pupil of foundation property tax in the district 3 of residence for the previous fiscal year; (2) either the 4 teacher leadership supplement district cost per pupil for the 5 previous fiscal year or the teacher leadership supplement 6 foundation aid for the previous fiscal year, if both the 7 district of residence and the receiving district are receiving 8 such supplements; (3) the teacher salary supplement district 9 cost per pupil for the previous fiscal year for the district of 10 residence; (4) the professional development supplement district 11 cost per pupil for the previous fiscal year for the district 12 of residence; (5) the early intervention supplement district 13 cost per pupil for the previous fiscal year for the district 14 of residence; (6) the area education agency teacher salary 15 supplement district cost per pupil for the previous fiscal year 16 for the district of residence; (7) the area education agency 17 professional development supplement district cost per pupil 18 for the previous fiscal year for the district of residence; 19 (8) the special education support services foundation base per 20 pupil for the previous fiscal year multiplied by the pupil’s 21 special education weighted enrollment for the previous fiscal 22 year; (9) any moneys received for the pupil as a result of the 23 non-English speaking weighting, for the previous school year 24 multiplied by the regular program state cost per pupil for the 25 previous fiscal year; and (10) the amount of any per pupil 26 federal funding received by the district of residence as the 27 result of the pupil. 28 By operation of law, the changes in the bill also apply 29 to the amount required to be paid by a resident district to 30 a charter school or innovation zone consortium under Code 31 chapter 256F when the pupil enrolls in such a school outside 32 the pupil’s district of residence. 33 The bill applies to school budget years beginning on or after 34 July 1, 2019. 35 -3- LSB 5830XS (2) 87 md/jh 3/ 3
