be

persons
of
the
same
biological

shall

be
an
unfair

practice

prohibit
a
person
from
using
a

multiple
occupancy
toilet
facility
that
does
not
correspond

the

sex
as

Multiple
occupancy
toilet

biological

1.
As
used
in
this
section:

a.
“Biological
sex”
means
the
physical
condition
of
being
13
male
or
female
as
indicated
on
a
person’s
birth
certificate.

b.
“Multiple
occupancy
toilet
facility”
means
a
toilet
15
facility
designed
or
designated
to
be
used
by
more
than
one
16
person
at
a
time.

c.
“School”
means
an
elementary
or
secondary
public
or
18
nonpublic
school
as
described
in
this
chapter.

2.
A
school
shall
require
a
multiple
occupancy
toilet
20
facility
to
be
designated
only
for
and
used
by
persons
of
21
the
same
biological
sex.
A
person
shall
not
enter
a
school
22
multiple
occupancy
toilet
facility
that
does
not
correspond
23
with
the
person’s
biological
sex.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
elementary
and
secondary
public
and
28
nonpublic
schools
to
designate
and
allow
the
use
of
multiple
29
occupancy
toilet
facilities
only
by
persons
of
the
same
30
biological
sex.
The
bill
prohibits
a
person
from
entering
31
a
school
multiple
occupancy
toilet
facility
that
does
not
32
correspond
with
the
person’s
biological
sex.
The
bill
provides
33
that
such
designations
and
prohibitions
do
not
constitute
34
unfair
or
discriminatory
practices
in
violation
of
the
Iowa
