S.F. 2289 Section 1. Section 28E.2, subsection 2, Code 2018, is 1 amended to read as follows: 2 2. “Public agency” shall mean any political subdivision of 3 this state; any agency of the state government or of the United 4 States; and any political subdivision of another state. For 5 purposes of this chapter only, “public agency” also includes any 6 federally recognized Indian tribe. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill defines a public agency only for purposes of 11 allowing the joint exercise of governmental powers under Code 12 chapter 28E to include any federally recognized Indian tribe. 13 -1- LSB 6145SV (1) 87 ec/rj 1/ 1
