S.F. 227 Section 1. Section 321G.13, subsection 2, paragraph b, Code 1 2017, is amended to read as follows: 2 b. (1) A person may operate or ride on a snowmobile with a 3 loaded firearm, whether concealed or not, without a permit to 4 carry weapons, if the person operates or rides on land owned , 5 or possessed , or rented by the person, and the person’s conduct 6 is otherwise lawful. 7 (2) If a person is operating or riding on a snowmobile on 8 land that is not owned , or possessed , or rented by the person, 9 the person may operate or ride the snowmobile with a loaded 10 firearm, whether concealed or not, if all of the following 11 apply: 12 (a) The firearm is a pistol or revolver and is secured in a 13 retention holster upon the person. 14 (b) The person has in the person’s possession and displays 15 to a peace officer on demand a valid permit to carry weapons 16 which has been issued to the person. 17 (c) The person’s conduct is within the limits of the permit 18 to carry weapons. 19 Sec. 2. Section 321G.13, Code 2017, is amended by adding the 20 following new subsection: 21 NEW SUBSECTION . 4. As used in this section, “rented by the 22 person” includes a person who does not necessarily rent the 23 land but who principally provides labor for the production of 24 crops located on agricultural land or for the production of 25 livestock principally located on agricultural land. The person 26 must personally provide such labor on a regular, continuous, 27 and substantial basis. 28 Sec. 3. Section 321I.14, subsection 2, paragraph b, Code 29 2017, is amended to read as follows: 30 b. (1) A person may operate or ride on an all-terrain 31 vehicle with a loaded firearm, whether concealed or not, 32 without a permit to carry weapons, if the person operates or 33 rides on land owned , or possessed , or rented by the person, and 34 the person’s conduct is otherwise lawful. 35 -1- LSB 2094XS (4) 87 jm/rh 1/ 3
S.F. 227 (2) If a person is operating or riding on an all-terrain 1 vehicle on land that is not owned , or possessed , or rented by 2 the person, the person may operate or ride the all-terrain 3 vehicle with a loaded firearm, whether concealed or not, if all 4 of the following apply: 5 (a) The firearm is a pistol or revolver and is secured in a 6 retention holster upon the person. 7 (b) The person has in the person’s possession and displays 8 to a peace officer on demand a valid permit to carry weapons 9 which has been issued to the person. 10 (c) The person’s conduct is within the limits of the permit 11 to carry weapons. 12 Sec. 4. Section 321I.14, Code 2017, is amended by adding the 13 following new subsection: 14 NEW SUBSECTION . 6. The person 19 must personally provide such labor on a regular, continuous, 20 and substantial basis. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill relates to operating or riding a snowmobile or 25 all-terrain vehicle while carrying a firearm. 26 Currently, a person may operate or ride on a snowmobile or 27 all-terrain vehicle with a loaded firearm, whether concealed or 28 not, without a permit to carry weapons, if the person operates 29 or rides on land owned by the person, and the person’s conduct 30 is otherwise lawful. 31 The bill allows a person to operate or ride on a snowmobile 32 or all-terrain vehicle with a loaded firearm, whether concealed 33 or not, without a permit to carry weapons, if the person 34 operates or rides on the snowmobile or all-terrain vehicle 35 -2- LSB 2094XS (4) 87 jm/rh 2/ 3
S.F. 227 on land rented by the person, and the person’s conduct is 1 otherwise lawful. The bill specifies that “rented by the 2 person” includes a person who does not necessarily rent the 3 land but who principally provides labor for the production of 4 crops located on agricultural land or for the production of 5 livestock principally located on agricultural land. The person 6 must personally provide such labor on a regular, continuous, 7 and substantial basis. 8 A person who violates Code section 321G.13 (snowmobiles) or 9 321I.14 (all-terrain vehicles) commits a simple misdemeanor 10 punishable as a scheduled fine of $100 under Code section 11 805.8B. 12 -3- LSB 2094XS (4) 87 jm/rh 3/ 3
