S.F. 2231 Section 1. Section 321G.13, subsection 2, paragraph b, Code 1 2018, is amended to read as follows: 2 b. (1) A person may operate or ride a snowmobile with a 3 loaded firearm, whether concealed or not, without a permit to 4 carry weapons, if the person operates or rides on land owned , 5 or possessed , or rented by the person , and the person’s conduct 6 is otherwise lawful. 7 (2) If A person may operate or ride on a snowmobile with 8 a loaded pistol or revolver, whether concealed or not, if a 9 person is operating or riding a the snowmobile on land that is 10 not owned , or possessed , or rented by the person, the person 11 may operate or ride the snowmobile with a loaded pistol or 12 revolver, whether concealed or not, and the person’s conduct is 13 otherwise lawful. 14 Sec. 2. Section 321G.13, Code 2018, is amended by adding the 15 following new subsection: 16 NEW SUBSECTION . 4. As used in this section, “rented by the 17 person” includes a person who does not necessarily rent the 18 land but who principally provides labor for the production of 19 crops located on agricultural land or for the production of 20 livestock principally located on agricultural land. The person 21 must personally provide such labor on a regular, continuous, 22 and substantial basis. 23 Sec. 3. Section 321I.14, subsection 2, paragraph b, Code 24 2018, is amended to read as follows: 25 b. (1) A person may operate or ride an all-terrain vehicle 26 with a loaded firearm, whether concealed or not, without a 27 permit to carry weapons, if the person operates or rides on 28 land owned , or possessed , or rented by the person , and the 29 person’s conduct is otherwise lawful. 30 (2) If A person may operate or ride on all all-terrain 31 vehicle with a loaded pistol or revolver, whether concealed 32 or not, if a person is operating or riding an the all-terrain 33 vehicle on land that is not owned , or possessed , or rented by 34 the person, the person may operate or ride the all-terrain 35 -1- LSB 2094SZ (2) 87 jm/rh 1/ 3
S.F. 2231 vehicle with a loaded pistol or revolver, whether concealed or 1 not, and the person’s conduct is otherwise lawful. 2 Sec. 4. Section 321I.14, Code 2018, is amended by adding the 3 following new subsection: 4 NEW SUBSECTION . 6. As used in this section “rented by the 5 person” includes a person who does not necessarily rent the 6 land but who principally provides labor for the production of 7 crops located on agricultural land or for the production of 8 livestock principally located on agricultural land. Section 724.4, subsection 4, paragraph a, Code 2018, 12 is amended to read as follows: 13 a. A person who goes armed with a dangerous weapon in the 14 person’s own dwelling or place of business, or on land owned , 15 or possessed , or rented by the person. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill relates to carrying weapons and operating or 20 riding a snowmobile or all-terrain vehicle while carrying a 21 loaded firearm. 22 Currently, a person may operate or ride on a snowmobile or 23 all-terrain vehicle with a loaded firearm, whether concealed or 24 not, without a permit to carry weapons, if the person operates 25 or rides on land owned by the person, and the person’s conduct 26 is otherwise lawful. 27 The bill allows a person to operate or ride on a snowmobile 28 or all-terrain vehicle with a loaded firearm, whether concealed 29 or not, without a permit to carry weapons, if the person 30 operates or rides on the snowmobile or all-terrain vehicle 31 on land rented by the person, and the person’s conduct is 32 otherwise lawful. The bill specifies that “rented by the 33 person” includes a person who does not necessarily rent the 34 land but who principally provides labor for the production of 35 -2- LSB 2094SZ (2) 87 jm/rh 2/ 3
S.F. 2231 crops located on agricultural land or for the production of 1 livestock principally located on agricultural land. The person 2 must personally provide such labor on a regular, continuous, 3 and substantial basis. 4 A person who violates Code section 321G.13 (snowmobiles) or 5 321I.14 (all-terrain vehicles) commits a simple misdemeanor 6 punishable as a scheduled fine of $100 under Code section 7 805.8B. 8 The bill amends Code section 724.4 relating to carrying 9 weapons. Currently, a person does not commit the criminal 10 offense of carrying weapons in violation of Code section 11 724.4 if the person goes armed with a dangerous weapon in the 12 person’s own dwelling or place of business, or on land owned or 13 possessed by the person, and the person does not qualify for 14 another exemption under Code section 724.4(4). Under the bill, 15 a person no longer commits the criminal offense of carrying 16 weapons in violation of Code section 724.4 if the person goes 17 armed with a dangerous weapon on land rented by the person, and 18 the person does not qualify for another exemption under Code 19 section 724.4. 20 -3- LSB 2094SZ (2) 87 jm/rh 3/ 3
