1.
NEW
SECTION
.

Use
of
automated
or
remote
1
systems
for
traffic
law
enforcement
prohibited.
2
The
state
or
a
political
subdivision
of
the
state
shall
not
3
place
or
cause
to
be
placed
on
or
adjacent
to
a
highway,
or
4
maintain
or
employ
the
use
of,
any
automated
or
remote
system
5
for
traffic
law
enforcement.
For
the
purposes
of
this
section,
6
“automated
or
remote
system
for
traffic
law
enforcement”
means
a
7
camera
or
other
optical
device
designed
to
work
in
conjunction
8
with
an
official
traffic
control
signal
or
speed
detection
9
equipment
to
identify
motor
vehicles
operating
in
violation
of
10
traffic
laws,
the
use
of
which
results
in
the
issuance
of
civil
11
infractions
sent
through
the
mail
or
by
electronic
means.

Sec.
2.
REMOVAL
OF
AUTOMATED
OR
REMOTE
SYSTEMS
FOR
TRAFFIC

LAW
ENFORCEMENT
——
VALIDITY
OF
PRIOR
NOTICES
AND
CITATIONS.
On
14
or
before
July
1,
2017,
a
local
authority
using
an
automated
15
or
remote
system
for
traffic
law
enforcement
shall
discontinue
16
using
the
system
and
remove
the
system
equipment.
Effective
17
July
1,
2017,
all
local
ordinances
authorizing
the
use
of
18
automated
or
remote
systems
for
traffic
law
enforcement
are
19
void.
However,
any
notice
of
violation
mailed
or
any
citation
20
issued
pursuant
to
such
an
ordinance
prior
to
July
1,
2017,
21
shall
not
be
invalidated
by
the
enactment
of
this
Act
and
shall
22
be
processed
according
to
the
provisions
of
the
law
under
which
23
it
was
authorized.

Sec.
3.
EFFECTIVE
UPON
ENACTMENT.
The
section
of
this
Act
25
relating
to
the
removal
of
automated
or
remote
systems
for
26
traffic
law
enforcement
and
the
validity
of
prior
notices
and
27
citations,
being
deemed
of
immediate
importance,
takes
effect
28
upon
enactment.

EXPLANATION
30
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
31
the
explanation’s
substance
by
the
members
of
the
general
assembly.
32
This
bill
imposes
a
statewide
prohibition
on
the
placement
33
and
use
of
automated
or
remote
systems
for
traffic
law
34
enforcement.
The
bill
defines
“automated
or
remote
system
for
35

traffic

enforcement”
to
mean
a
camera
or
other
optical
1
device
designed
to
work
in
conjunction
with
an
official
traffic

control

the
use
of

which

in
the

This
provision

the
bill

systems
for
traffic

enforcement
must

On
that
date,

systems

enforcement
