S.F. 2192 Section 1. Section 321.438, subsection 2, Code 2018, is 1 amended to read as follows: 2 2. a. A person shall not operate on the highway a motor 3 vehicle equipped with a front windshield, a side window to the 4 immediate right or left of the driver, or a side-wing sidewing 5 forward of and to the left or right of the driver which is 6 excessively dark or reflective so that it is difficult for a 7 person outside the motor vehicle to see into the motor vehicle 8 through the windshield, window, or sidewing. 9 b. A person shall not sell a motor vehicle equipped with 10 a front windshield, a side window to the immediate right or 11 left of the driver, or a sidewing forward of and to the left or 12 right of the driver which is excessively dark or reflective so 13 that it is difficult for a person outside the motor vehicle to 14 see into the motor vehicle through the windshield, window, or 15 sidewing. 16 c. A person shall not install in a motor vehicle a front 17 windshield, a side window to the immediate right or left of the 18 driver, or a sidewing forward of and to the left or right of the 19 driver which is excessively dark or reflective so that it is 20 difficult for a person outside the motor vehicle to see into 21 the motor vehicle through the windshield, window, or sidewing. 22 d. The department shall adopt rules establishing a minimum 23 measurable standard of transparency which shall apply to 24 violations of this subsection . 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 Under current law, a person is prohibited from operating on 29 the highway a motor vehicle equipped with a front windshield, 30 a side window to the immediate right or left of the driver, or 31 a sidewing forward of and to the left or right of the driver 32 which is excessively dark or reflective so that it is difficult 33 for a person outside the vehicle to see into the vehicle 34 through the windshield, window, or sidewing. Under rules 35 -1- LSB 5051XS (3) 87 ns/rh 1/ 2
S.F. 2192 adopted by the department of transportation, “excessively dark 1 or reflective” means that the windshield, front side window, or 2 front sidewing does not meet a minimum standard of transparency 3 of 70 percent light transmittance. 4 This bill prohibits a person from selling a motor vehicle 5 equipped with a front windshield, a side window to the 6 immediate right or left of the driver, or a sidewing forward 7 of and to the left or right of the driver which is excessively 8 dark or reflective. The bill also prohibits a person from 9 installing in a motor vehicle a front windshield, a side 10 window to the immediate right or left of the driver, or a 11 sidewing forward of and to the left or right of the driver 12 which is excessively dark or reflective.
