S.F. 2188 Section 1. Section 456.1, Code 2018, is amended by striking 1 the section and inserting in lieu thereof the following: 2 456.1 Geological survey created. 3 A geological survey of the state is created within the 4 Iowa flood center at the state university of Iowa under the 5 jurisdiction and authority of the state board of regents. 6 Sec. 2. Section 456.2, Code 2018, is amended to read as 7 follows: 8 456.2 State geologist —— qualifications —— salary . 9 The director state board of regents shall appoint the 10 state geologist . The state geologist , who must have hold, 11 at minimum, a master’s degree in geology from an accredited 12 college or university and must have at least five years 13 of geological experience. The annual salary of the state 14 geologist shall be determined by the director state board of 15 regents . 16 Sec. 3. Section 456.4, Code 2018, is amended to read as 17 follows: 18 456.4 Investigations —— collection —— renting space . 19 The state geologist shall investigate the characters of the 20 various soils and their capacities for agricultural purposes, 21 the streams, and other scientific and natural resource matters 22 that may be of practical importance and interest. For the 23 purpose of preserving well drilling samples, rock cores, 24 fossils, and other materials as may be necessary to carry on 25 investigations, the state geologist board of regents shall have 26 the authority to lease or rent provide sufficient space for 27 storage of these materials with the approval of the director of 28 the department of administrative services . A complete cabinet 29 collection may be made to illustrate the natural products of 30 the state, and the state geologist may also furnish suites of 31 materials, rocks, and fossils for colleges and public museums 32 within the state, if it can be done without impairing the 33 general state collection. 34 Sec. 4. Section 456.7, Code 2018, is amended to read as 35 -1- LSB 5799SS (8) 87 kh/tm 1/ 4
S.F. 2188 follows: 1 456.7 Annual report Reports —— publication of survey . 2 1. The state geologist shall, annually, at the time provided 3 by law, make submit to the state board of regents, the general 4 assembly, and the governor a full report of the work in the 5 preceding year, which report shall be accompanied by such 6 other reports and papers as may be considered desirable for 7 publication. 8 2. The state geologist shall make and maintain detailed 9 maps and reports of counties and districts, which reports shall 10 embrace such geological, mineralogical, topographical, and 11 scientific details as are necessary to make complete records, 12 which may include the necessary illustrations, maps, charts, 13 and diagrams. 14 3. The state geologist may direct the preparation and 15 publication of special reports and bulletins of educational and 16 scientific value or containing information of immediate use to 17 the public. 18 4. The geological survey shall be published on the state 19 university of Iowa’s internet site. 20 Sec. 5. Section 466C.1, subsection 2, Code 2018, is amended 21 by adding the following new paragraph: 22 NEW PARAGRAPH . e. To provide office space and staff support 23 for the state geologist. 24 Sec. 6. ENVIRONMENT FIRST FUND —— STATE GEOLOGICAL SURVEY —— 25 TRANSFER OF FUNDS. There is appropriated from the environment 26 first fund created in section 8.57A to the state board of 27 regents for the fiscal year beginning July 1, 2018, and ending 28 June 30, 2019, the following amount, or so much thereof as is 29 necessary, to be used for the purposes designated: 30 1. For the state geological survey, including salaries, 31 support, maintenance, and miscellaneous purposes: 32 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 200,000 33 2. Notwithstanding section 8.33, moneys appropriated 34 pursuant to 2017 Iowa Acts, chapter 168, section 18, subsection 35 -2- LSB 5799SS (8) 87 kh/tm 2/ 4
S.F. 2188 8, that remain unencumbered and unobligated at the close of the 1 fiscal year shall not revert. Such moneys are appropriated to 2 the state board of regents for the fiscal year beginning July 3 1, 2018, and ending June 30, 2019, for purposes of the state 4 geological survey. 5 Sec. 7. REPEAL. Sections 456.6, 456.9, and 456.10, Code 6 2018, are repealed. 7 Sec. 8. REPEAL. 2017 Iowa Acts, chapter 168, section 53, 8 subsection 8, is repealed. 9 Sec. 9. EFFECTIVE DATE. This Act, being deemed of immediate 10 importance, takes effect upon enactment. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill transfers the state geologist from the department 15 of natural resources to the Iowa flood center at the state 16 university of Iowa under the jurisdiction and authority of 17 the state board of regents, and appropriates moneys from the 18 environment first fund to the state board of regents for 19 purposes of the state geological survey. 20 Currently, the director of the department of natural 21 resources appoints and sets the salary of the state geologist. 22 The bill moves this authority to the state board of regents and 23 requires that the person appointed as state geologist hold, at 24 a minimum, a master’s degree in geology. 25 The bill combines a number of the state geologist’s 26 reporting requirements into one Code section and provides that 27 the geological survey must be published on the state university 28 of Iowa’s internet site. 29 Currently, the state geologist is authorized to lease 30 or rent storage space for geological samples and materials 31 with the approval of the director of the department of 32 administrative services. The bill directs the state board of 33 regents to provide sufficient space for such purposes. 34 The bill makes an appropriation to the state board of 35 -3- LSB 5799SS (8) 87 kh/tm 3/ 4
S.F. 2188 regents for FY 2018-2019 from the environment first fund and 1 provides that moneys remaining from an appropriation to the 2 department of natural resources from the environment first 3 fund for FY 2017-2018 for purposes of the state geological 4 survey shall not revert at the end of the fiscal year and are 5 appropriated to the state board of regents to be used for the 6 state geological survey in the following fiscal year. 7 The bill takes effect upon enactment. 8 -4- LSB 5799SS (8) 87 kh/tm 4/ 4
