Section
1.
Section
15F.107,
Code
2017,
is
amended
to
read

as
follows:

15F.107
Enhance
Iowa
fund
and
appropriation
.

1.
a.
The
authority
shall
establish
a
fund
pursuant
to
4
section
15.106A,
subsection
1
,
paragraph
“o”
,
for
purposes
of
5
allocating
moneys
to
programs
specified
in
an
appropriation
6
made
to
the
enhance
Iowa
fund
described
in
this
section
.
7
A
fund
established
for
purposes
of
this
section
may
be
8
administered
as
a
revolving
fund
and
may
consist
of
any
moneys
9
appropriated
by
the
general
assembly
for
purposes
of
this
10
section
.
11
b.
Notwithstanding
section
8.33
,
at
the
end
of
each
fiscal
12
year
moneys
in
a
fund
established
for
purposes
of
this
section
13
shall
not
revert
to
any
other
fund
but
shall
remain
in
the
fund
14
for
expenditure
for
subsequent
fiscal
years.
15
c.
Notwithstanding
section
12C.7,
subsection
2
,
interest
or
16
earnings
on
moneys
in
the
fund
shall
be
credited
to
the
fund.
17
Repayments
and
recaptures
of
program
moneys
shall
be
credited
18
to
the
fund.

2.
Commencing
with
appropriations
made
for
purposes
of
20
this
section
for
the
fiscal
year
beginning
July
1,
2017,
and
21
for
each
fiscal
year
thereafter,
not
to
exceed
a
total
of
ten
22
fiscal
year
appropriations,
if
moneys
are
transferred
to
the
23
general
fund
of
the
state
pursuant
to
section
8.55,
subsection
24
2,
paragraph
“b”
,
during
a
fiscal
year
in
an
amount
that
exceeds
25
one
hundred
million
dollars,
there
is
appropriated
from
the
26
general
fund
of
the
state
to
the
authority
for
deposit
in
27
the
fund
created
pursuant
to
subsection
1,
for
that
fiscal
28
year,
twenty-five
million
dollars
to
be
used
for
the
purposes
29
designated
in
this
section.
30
3.
Moneys
appropriated
to
the
fund
pursuant
to
subsection
2
31
shall
be
allocated
by
the
authority
for
the
following
purposes

and
in
the
following
amounts:

a.
For
purposes
of
administration,
marketing
enhance
Iowa

programs,
expenses,
and
compensation
of
board
members,

parks
infrastructure,

financing
low
head
dam
mitigation
or
removal
projects,
or

funding
projects
under
the
natural
resources
account
created
in

section
461.32
in
the
natural
resources
and
outdoor
recreation
16
trust
fund,
two
million
dollars.

For
purposes
of
funding
projects
under
the
watershed
18
protection
account
created
in
section
461.34
in
the
natural
19
resources
and
outdoor
recreation
trust
fund,
two
million
20
dollars.

(3)
For
purposes
of
funding
projects
under
the
trails
22
account
created
in
section
461.37
in
the
natural
resources
and
23
outdoor
recreation
trust
fund,
two
million
dollars.

(4)
The
departments
of
natural
resources,
transportation,
25
and
agriculture
and
land
stewardship
shall
submit
applications
26
to
the
board
for
each
project
to
be
funded
pursuant
to
this
27
paragraph
“e”
.
The
board
shall
prioritize
the
projects
and
28
negotiate
with
the
departments
on
which
projects
to
fund
29
pursuant
to
this
paragraph
“e”
.

For
allocation
to
the
funds,
programs,
and
purposes

described
in
paragraphs
“a”
through
“e”
,
at
the
discretion
of

the
board,
twelve
million
seven
hundred
fifty
thousand
dollars.

4.
Moneys
allocated
pursuant
to
subsection
3,
paragraphs
“e”

and
“f”
,
to
the
department
of
natural
resources
shall
not
be

expended
by
the
department
for
the
purpose
of
acquiring
lands,
1
waters,
or
interests
in
lands
and
waters.

If,
at
any
point
in
a
fiscal
year,
the
board
determines
3
that
demand
for
any
one
of
the
purposes
described
in
subsection
4
3
will
not
meet
or
exceed
the
amounts
initially
allocated,
the
5
board
may
reallocate
amounts
from
one
purpose
to
any
of
the
6
other
purposes
for
that
fiscal
year
or
may
carry
the
moneys
7
allocated
to
any
one
purpose
over
to
a
future
fiscal
year
for
8
that
same
purpose
in
the
next
fiscal
year.

The
authority
shall
submit
a
report
to
the
general
10
assembly
and
the
governor’s
office
each
year
that
moneys
are
11
appropriated
to
the
fund
established
in
this
section
describing
12
the
use
of
moneys
and
the
results
achieved
under
each
of
the
13
programs
receiving
fund
moneys.

EXPLANATION
15
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
16
the
explanation’s
substance
by
the
members
of
the
general
assembly.
17
This
bill
provides
for
contingent
appropriations
to,
and
18
allocations
from,
the
enhance
Iowa
fund.
The
bill
requires
a
19
contingent
fiscal
year
appropriation
of
$25
million
from
the
20
general
fund
of
the
state
to
the
enhance
Iowa
fund.
The
bill
21
provides
for
appropriations
in
that
amount
for
10
fiscal
years,
22
beginning
with
the
2017-2018
fiscal
year.
Under
the
bill,
23
the
$25
million
appropriation
occurs
only
if
the
general
fund
24
receives
a
transfer
of
over
$100
million
in
that
fiscal
year
25
from
the
Iowa
economic
emergency
fund,
pursuant
to
Code
section
26
8.55.
Moneys
in
the
fund
shall
not
revert
to
the
general
27
fund
and
interest
and
earnings
on
the
fund
are
required
to
be
28
credited
to
the
fund.

The
bill
requires
that
the
authority
allocate
moneys
in
30
the
fund
to
specified
funds
or
accounts
or
for
specified
31
purposes.
The
bill
allows
the
enhance
Iowa
board
(board)
to
32
reallocate
amounts
from
one
purpose
to
other
purposes
if
the
33
board
determines
that
demand
for
one
purpose
will
not
meet
34
or
exceed
the
amounts
allocated
for
that
purpose.

for
the
following
allocations
in
fiscal
years
when
the

fund
receives
the
appropriation
of
$25
million:

$250,000
for
administration,
expenses,
and
compensation
of
3
board
members,
and
marketing
enhance
Iowa
programs.

2.
$1
million
for
deposit
in
the
sports
program
fund.

3.
$3
million
for
deposit
in
the
community
attraction
and
6
tourism
fund.
7
4.
$2
million
for
deposit
in
the
river
enhancement
community
8
attraction
and
tourism
fund.

5.
$6
million
for
allocation
as
grants,
at
the
discretion
10
of
the
board,
to
the
department
of
natural
resources,
11
the
department
of
transportation,
or
the
department
of
12
agriculture
and
land
stewardship
for
specified
allowable
13
purposes.
Under
the
bill,
the
departments
are
required
14
to
submit
applications
to
the
board
for
each
project
to
15
be
funded
from
the
$6
million
allocation
and
the
board
is
16
required
to
prioritize
the
projects
and
negotiate
with
the
17
departments
on
which
projects
to
fund.

6.
$12.75
million
for
allocation,
at
the
discretion
of
the
19
board,
to
the
above-listed
funds,
programs,
and
purposes.
20
Under
the
bill,
the
department
of
natural
resources
is
21
prohibited
from
using
moneys
from
the
fund
to
acquire
lands,
22
waters,
and
interests
in
lands
and
waters.
