Section
321.453,
Code
2017,
is
amended
by
adding
1
the
following
new
subsection:

SUBSECTION

Notwithstanding
section
321.463,
3
321.471,
or
321.474,
chapter
321E,
or
any
other
provision

of
law
to
the
contrary,
the
department
or
a
local
authority
5
shall
not
require
a
permit
for
the
operation
of
a
motor
6
vehicle
transporting
an
implement
of
husbandry
between
fields,
7
locations
for
repair,
or
locations
for
storage
of
the
implement
8
of
husbandry.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Code
section
321.453
exempts
certain
motor
vehicles
and
13
equipment
from
the
provisions
of
Code
chapter
321
(motor
14
vehicles
and
law
of
the
road)
governing
size,
weight,
and
load,
15
and
the
permit
requirements
of
Code
chapter
321E
(vehicles
of
16
excessive
size
and
weight).
Such
motor
vehicles
and
equipment
17
include
fire
apparatus,
certain
road
maintenance
equipment,
18
implements
of
husbandry
when
moved
or
moving
upon
a
highway
19
that
is
not
a
portion
of
the
interstate,
and
certain
equipment
20
used
primarily
for
construction
of
permanent
conservation
21
practices
on
agricultural
land.
However,
such
motor
vehicles
22
and
equipment
are
not
exempt
from
the
provisions
of
Code
23
section
321.463
(maximum
gross
weight),
321.471
(restrictions
24
by
local
authorities),
or
321.474
(restrictions
by
the
25
department
of
transportation),
which
include
certain
permitting
26
provisions.

This
bill
provides
that
the
department
of
transportation
or
28
a
local
authority
shall
not
require
a
permit
for
the
operation
29
of
a
motor
vehicle
transporting
an
implement
of
husbandry
30
between
fields,
locations
for
repair,
or
locations
for
storage
31
of
the
implement
of
husbandry.
