S.F. 2034 Section 1. NEW SECTION . 282.19A Foster children and 1 adoption subsidy payments —— private instruction prohibited. 2 A child placed in foster care and subsequently adopted shall 3 be enrolled or remain enrolled in and attend an accredited 4 school in the school district in which the child is living or 5 an accredited nonpublic school if the adoptive parent receives 6 financial assistance as provided in section 600.17. Such a 7 child shall not be placed in competent private instruction or 8 independent private instruction under chapter 299A. 9 Sec. 2. NEW SECTION . 299A.9A Foster children and adoption 10 subsidy payments —— private instruction prohibited. 11 A child of compulsory attendance age placed in foster 12 care and subsequently adopted is not eligible for placement 13 under competent private instruction or independent private 14 instruction as provided in section 282.19A. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill prohibits placing former foster children under 19 private instruction if the adoptive parents receive an adoption 20 subsidy. 21 The bill provides that a child placed in foster care and 22 subsequently adopted is required to be enrolled or remain 23 enrolled in, and attend, an accredited school in the school 24 district in which the child is living or an accredited 25 nonpublic school if the adoptive parent receives an adoption 26 subsidy.
