person

has
fulfilled
all

the
requirements
for

licensure
under
this
chapter
,
except
for
having
completed
4
the
postgraduate
supervised
clinical
experience
requirement
5
as
determined
by
the
board
by
rule,
may
apply
to
the
board
6
for
a
temporary
license.
The
license
shall
be
designated
7
“temporary
license
in
marital
and
family
therapy”
,
“temporary
8
license
in
clinical
art
therapy”,
or
“temporary
license
in
9
mental
health
counseling”
and
shall
authorize
the
licensee
to
10
practice
marital
and
family
therapy
,
clinical
art
therapy,
or
11
mental
health
counseling
under
the
supervision
of
a
qualified
12
supervisor
as
determined
by
the
board
by
rule.
The
license
13
shall
be
valid
for
three
years
and
may
be
renewed
at
the
14
discretion
of
the
board.
The
fee
for
a
temporary
license
15
shall
be
set
by
the
board
to
cover
the
administrative
costs
of
16
issuing
the
license,
and
if
renewed,
a
renewal
fee
as
set
by
17
the
board
shall
be
required.

12.
NEW
SECTION
.
154D.8
Licensure
——
clinical
art
19
therapy.
20
1.
An
applicant
for
a
license
to
practice
clinical
art
21
therapy
shall
be
granted
a
license
by
the
board
when
the
22
applicant
satisfies
all
of
the
following
requirements:
23
a.
Possesses
a
master’s
or
doctoral
degree
from
a
nationally
24
accredited
institution
consisting
of
at
least
sixty
semester
25
hours,
or
its
equivalent,
in
one
of
the
following
art
therapy
26
programs:
27
(1)
A
program
approved
by
the
American
art
therapy
28
association
or
its
successor.
29
(2)
A
program
accredited
by
the
commission
on
accreditation
30
of
allied
health
education
programs
at
the
time
the
degree
was
31
conferred.
32
(3)
A
substantially
equivalent
program
as
approved
by
the
33
board.
34
b.
Has
at
least
two
years
of
supervised
experience
or
its
35

equivalent
as

board
that
satisfies
all
of
the

following

contact
and
two

hundred
hours
of
clinical
supervision.

clinical
settings
that
provide

opportunities
to
diagnose,
treat,
appraise
and
assess
8
mental,
emotional,
behavioral
and
addiction
disorders
in
both
9
individual
and
group
settings,
as
determined
by
the
board
by
10
rule.
11
(3)
Provides
for
supervision
by
an
art
therapy
certified
12
supervisor,
licensed
clinical
art
therapist,
board
certified
13
art
therapist,
or
other
qualified
licensed
mental
health
14
professional
approved
by
the
board.
Applicants
beginning
15
supervised
experience
on
or
after
January
1,
2019,
shall
16
complete
at
least
five
hundred
hours
of
direct
client
contact
17
under
supervision
by
an
art
therapy
certified
supervisor
or
18
board
certified
art
therapist.
19
c.
Passes
the
national
board
examination
of
the
art
therapy
20
credentials
board
or
its
successor.

2.
The
board
may
make
a
determination
that
a
program
is

substantially
equivalent
to
a
master’s
degree
program
in

the

the

Sec.
13.
TRANSITION
PROVISIONS.
17
1.
Notwithstanding
sections
147.14,
as
amended
in
this
18
Act,
and
147.16,
the
governor
may
appoint,
as
the
initial
19
member
licensed
to
practice
clinical
art
therapy
to
the
board
20
of
behavioral
science
pursuant
to
section
147.14,
subsection
21
1,
paragraph
“m”,
as
amended
in
this
Act,
an
individual
who
22
is
credentialed
as
a
board-certified
art
therapist
by
the
23
art
therapy
credentials
board
with
experience
and
expertise
24
substantially
equivalent
to
the
requirements
for
licensure
as
a
25
clinical
art
therapist
under
section
154D.8,
as
enacted
in
this
26
Act.
27
2.
Notwithstanding
section
154D.8,
subsection
1,
as
28
enacted
in
this
Act,
during
the
period
of
one
year
from
the
29
effective
date
of
rules
implementing
this
Act,
the
board
30
may
grant
a
license
to
practice
clinical
art
therapy
for
an
31
applicant
who
provides
documentation
satisfactory
to
the
board
32
that
the
applicant
holds
a
credential
in
good
standing
as
a
33
board-certified
art
therapist
with
the
art
therapy
credentials
34
board
and
has
been
engaged
in
the
practice
of
clinical
art
35

not

at

adopted

board

and
assess
mental,
emotional,
behavioral,
and

addiction
disorders
in
both
individual
and

settings,
as

by
the
board

Notwithstanding
section
154D.8,
subsection
1,
paragraph
8
“b”,
as
enacted
in
this
Act,
during
the
period
of
three
years
9
from
the
effective
date
of
rules
implementing
this
Act,
the
10
board
shall
accept
for
purposes
of
qualifying
an
applicant
for
11
a
temporary
license
to
practice
clinical
art
therapy
under
12
supervision
in
accordance
with
section
154D.7,
as
amended
13
in
this
Act,
a
plan
for
supervision
that
includes
direct
14
clinical
supervision
by
an
individual
who
is
credentialed
as
a
15
registered
art
therapist
by
the
art
therapy
credentials
board
16
who
has
been
engaged
in
the
practice
of
clinical
art
therapy
17
for
not
less
than
five
years,
as
determined
by
the
board
by
18
rule.

Sec.
14.
EFFECTIVE
DATE
AND
IMPLEMENTATION.
This
Act
20
shall
take
effect
January
1,
2019,
except
that
the
board
of
21
behavioral
science
may
begin
implementation
prior
to
that
date,
22
to
the
extent
necessary
to
fully
implement
the
provisions
23
providing
for
the
licensure
of
clinical
art
therapists
by
24
January
1,
2019.
25
EXPLANATION
26
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
27
the
explanation’s
substance
by
the
members
of
the
general
assembly.
28
This
bill
provides
for
the
licensure
of
clinical
art
29
therapists.
Under
the
bill,
the
board
of
behavioral
science
30
shall
administer
the
licensure
of
clinical
art
therapists
and
31
shall
adopt
rules
relating
to
the
practice
of
clinical
art
32
therapy.
The
bill
modifies
the
membership
of
the
board
of
33
behavioral
science
to
add
one
clinical
art
therapist
and
remove
34
one
public
member.
The
bill
provides
that
persons
not
licensed
35

the
bill
but
referring
to
themselves
as
clinical
art
1
therapists
or
using
other
similar
terms
or
abbreviations
shall
2
be
guilty
of
a
simple
misdemeanor.
A
simple
misdemeanor
is
3
punishable
by
confinement
for
no
more
than
30
days
or
a
fine
of
4
at
least
$65
but
not
more
than
$625
or
by
both.
5
The
bill
defines
several
terms
including
“art
therapy”
6
and
“clinical
art
therapy”.
The
bill
provides
for
temporary
7
licensure
of
clinical
art
therapists.
The
bill
requires
that
8
to
acquire
a
license
to
practice
art
therapy,
an
applicant
9
must
have
a
master’s
or
doctoral
degree
in
art
therapy
from
10
a
program
approved
by
the
American
art
therapy
association,
11
accredited
by
the
commission
on
accreditation
of
allied
health
12
education
programs
at
the
time
the
degree
was
conferred,
or
13
another
program
approved
by
the
board
of
behavioral
science,
14
pass
a
national
board
examination,
and
complete
at
least
15
two
years
of
supervised
experience.
The
bill
allows
other
16
licensees
under
Code
chapter
154D
to
use
art
or
art
materials
17
as
part
of
their
practice
without
an
art
therapy
license
if
18
they
do
not
represent
that
they
practice
art
therapy.
19
The
bill
includes
licensed
certified
art
therapists
as
20
“health
care
providers”
eligible
to
provide
services
through
21
the
volunteer
health
care
provider
program
created
in
Code
22
section
135.24.
The
bill
provides
that
the
board
of
behavioral
23
science
may
waive
the
licensing
requirements
established
by
24
the
bill
for
persons
with
certain
qualifications
in
the
first
25
year
after
rules
implementing
the
licensure
of
clinical
art
26
therapists
are
adopted.
The
bill
also
directs
the
board
to
27
grant
temporary
licenses
to
applicants
seeking
to
practice
28
clinical
art
therapy
under
supervision
whose
supervision
plan
29
includes
supervision
by
a
registered
art
therapist
who
has
been
30
practicing
for
at
least
five
years.
This
directive
applies
for
31
the
first
three
years
following
the
effective
date
of
rules
32
implementing
the
bill.
The
bill
includes
an
effective
date
of
33
January
1,
2019,
except
that
the
board
of
behavioral
science

may
begin
implementation
prior
to
that
date,
to
the
extent
