1.
MEDICAID

AND
COMMUNITY-BASED

WAIVER

HOME
DELIVERED
MEALS.
The
department
of
2
human
services
shall
adopt
rules
pursuant
to
chapter
17A
to
3
include
home
delivered
meals
as
a
service
available
under
all
4
home
and
community-based
services
waivers.
If
necessary,
the
5
department
of
human
services
shall
request
federal
approval
6
of
a
medical
assistance
state
plan
amendment
or
waiver
to
7
implement
this
section
effective
July
1,
2017.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT
AND
CONTINGENT
9
IMPLEMENTATION.
This
Act,
being
deemed
of
immediate
10
importance,
takes
effect
upon
enactment.
However,
if
federal
11
approval
is
necessary,
the
department
of
human
services
shall
12
implement
this
Act
effective
July
1,
2017,
contingent
upon
13
receipt
of
federal
approval
of
the
state
plan
amendment
or
14
waiver
request
submitted
under
this
Act.

EXPLANATION
16
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
17
the
explanation’s
substance
by
the
members
of
the
general
assembly.
18
This
bill
directs
the
department
of
human
services
(DHS)
19
to
adopt
administrative
rules
to
include
home
delivered
meals
20
as
a
service
available
under
all
home
and
community-based
21
services
waivers.
If
necessary,
DHS
shall
request
federal
22
approval
of
a
medical
assistance
state
plan
amendment
or
23
waiver
to
implement
the
bill
effective
July
1,
2017.
The
bill
24
takes
effect
upon
enactment.
However,
if
federal
approval
is
25
necessary,
implementation
of
the
bill
effective
July
1,
2017,
26
is
contingent
upon
receipt
of
such
federal
approval.
