S.F. 164 Section 1. Section 388.6, Code 2017, is amended to read as 1 follows: 2 388.6 Discrimination in rates —— exceptions . 3 1. A city utility or a combined utility system may not 4 provide use or service at a discriminatory rate, except to the 5 city or its agencies, as provided in section 384.91 . 6 2. Notwithstanding subsection 1, a city utility or a 7 combined utility system may provide use or service at a reduced 8 rate to persons who are at least sixty-five years of age or 9 older. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 Current Code section 388.6 prohibits city utilities and 14 combined utility systems from providing discriminatory rates to 15 customers, except to cities or its agencies. 16 This bill authorizes city utilities and combined utility 17 systems to provide use or service at a reduced rate to persons 18 who are at least 65 years of age or older. 19 -1- LSB 1696XS (4) 87 gh/sc 1/ 1
