S.F. 120 Section 1. Section 257.11, subsection 5, Code 2017, is 1 amended to read as follows: 2 5. Shared operational functions —— increased student 3 opportunities —— budget years beginning in 2014 through 2019 4 2029 . 5 a. (1) In order to provide additional funding to increase 6 student opportunities and redirect more resources to student 7 programming for school districts that share operational 8 functions, a district that shares with a political subdivision 9 one or more operational functions of a curriculum director or 10 school counselor, or one or more operational functions in the 11 areas of superintendent management, business management, human 12 resources, transportation, or operation and maintenance for at 13 least twenty percent of the school year shall be assigned a 14 supplementary weighting for each shared operational function. 15 A school district that shares an operational function in 16 the area of superintendent management shall be assigned a 17 supplementary weighting of eight pupils for the function. A 18 school district that shares an operational function in the area 19 of business management, human resources, transportation, or 20 operation and maintenance shall be assigned a supplementary 21 weighting of five pupils for the function. A school district 22 that shares the operational functions of a curriculum director 23 or a school counselor shall be assigned a supplementary 24 weighting of three pupils for the function. The additional 25 weighting shall be assigned for each discrete operational 26 function shared. However, a school district may receive the 27 additional weighting under this subsection for sharing the 28 services of an individual with a political subdivision even if 29 the type of operational function performed by the individual 30 for the school district and the type of operational function 31 performed by the individual for the political subdivision are 32 not the same operational function, so long as both operational 33 functions are eligible for weighting under this subsection . S.F. 120 weighting for the type of operational function that the 1 individual performs for the school district, and the school 2 district shall not receive additional weighting for any other 3 function performed by the individual. The operational function 4 sharing arrangement does not need to be a newly implemented 5 sharing arrangement to receive supplementary weighting under 6 this subsection . 7 (2) For the purposes of this section , “political 8 subdivision” means a city, township, county, school corporation, 9 merged area, area education agency, institution governed by the 10 state board of regents, or any other governmental subdivision. 11 b. School districts that share operational functions with 12 other school districts are not required to be contiguous school 13 districts. If two or more districts sharing operational 14 functions are not contiguous to each other, the districts 15 separating those districts are not required to be a party to 16 the operational functions sharing arrangement. 17 c. Supplementary weighting pursuant to this subsection 18 shall be available to a school district for a maximum of 19 five years during the period commencing with the budget year 20 beginning July 1, 2014, through the budget year beginning July 21 1, 2019 2029 . The maximum amount of additional weighting for 22 which a school district shall be eligible in a budget year 23 is twenty-one additional pupils. Criteria for determining 24 the qualification of operational functions for supplementary 25 weighting shall be determined by the department by rule, 26 through consideration of increased student opportunities. 27 d. Supplementary weighting pursuant to this subsection 28 shall be available to an area education agency for a maximum of 29 five years during the period commencing with the budget year 30 beginning July 1, 2014, through the budget year beginning July 31 1, 2019 2029 . The minimum amount of additional funding for 32 which an area education agency shall be eligible in a budget 33 year is thirty thousand dollars, and the maximum amount of 34 additional funding for which an area education agency shall 35 -2- LSB 1912XS (4) 87 md/sc 2/ 3
S.F. 120 be eligible is two hundred thousand dollars. The department 1 of management shall annually set a weighting for each area 2 education agency to generate the approved operational sharing 3 expense using the area education agency’s special education 4 cost per pupil amount and foundation level. Criteria for 5 determining the qualification of operational functions 6 for supplementary weighting shall be determined by the 7 department by rule, through consideration of increased student 8 opportunities. 9 e. This subsection is repealed effective July 1, 2020 2030 . 10 Sec. 2. APPLICABILITY. This Act applies to school budget 11 years beginning on or after January 1, 2018. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 Code section 257.11(5) provides supplementary weighting 16 for school districts and area education agencies that share 17 operational functions. A district that shares with a political 18 subdivision one or more operational functions of a curriculum 19 director or school counselor, or one or more operational 20 functions in the areas of superintendent management, business 21 management, human resources, transportation, or operation and 22 maintenance for at least 20 percent of the school year is 23 assigned a supplementary weighting for each shared operational 24 function. Supplementary weighting under this provision is 25 available for a maximum of five school budget years beginning 26 July 1, 2014, through the budget year beginning July 1, 2019. 27 This bill strikes the provisions limiting the number of 28 years for which the weighting may be claimed. The bill also 29 extends the period of school budget years during which the 30 weighting for shared operational functions may be claimed so 31 that the period ends on the last day of the school budget year 32 beginning July 1, 2029. 33 The bill applies to school budget years beginning on or after 34 July 1, 2018. 35 -3- LSB 1912XS (4) 87 md/sc 3/ 3
