S.F. 108 Section 1. Section 724.1, subsection 1, paragraphs a and b, 1 Code 2017, are amended by striking the paragraphs. 2 Sec. 2. NEW SECTION . 724.32 Right to possess weapons. 3 If a person is in compliance with federal law, this chapter 4 shall not be construed to impose general prohibitions on 5 the unlicensed carrying, whether openly or concealed, of a 6 dangerous weapon, including a loaded firearm. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill relates to carrying weapons including eliminating 11 prohibitions on possessing certain weapons. 12 The bill strikes the prohibition on possessing a machine 13 gun, a short-barreled rifle, or a short-barreled shotgun. 14 Under current law, a person who possesses such weapons commits 15 a class “D” felony. Federal law in 18 U.S.C. §922 governs 16 the regulation of a machine gun, short-barreled rifle, or 17 short-barreled shotgun. 18 The bill also specifies that Code chapter 724 (weapons) 19 shall not be construed to impose general prohibitions on 20 the unlicensed carrying, whether openly or concealed, of a 21 dangerous weapon, including a loaded firearm, if a person is 22 in compliance with federal law. 23 -1- LSB 1419XS (3) 87 jm/rj/rh 1/ 1
