H.F. _____ (b) The moneys appropriated in this lettered paragraph 1 shall be used to support demonstration projects in watersheds 2 generally, including regional watersheds, as designated by the 3 division and high-priority watersheds identified by the water 4 resources coordinating council. 5 (3) In supporting projects in watersheds and subwatersheds 6 as provided in subparagraph (2), subparagraph divisions (a) and 7 (b), all of the following shall apply: 8 (a) The demonstration projects shall utilize water quality 9 practices as described in the latest revision of the document 10 entitled “Iowa Nutrient Reduction Strategy” initially presented 11 in November 2012 by the department of agriculture and land 12 stewardship, the department of natural resources, and Iowa 13 state university of science and technology. 14 (b) The division shall implement demonstration projects 15 as provided in subparagraph division (a) by providing 16 for participation by persons who hold a legal interest in 17 agricultural land used in farming. To every extent practical, 18 the division shall provide for collaborative participation by 19 such persons who hold a legal interest in agricultural land 20 located within the same subwatershed. 21 (c) The division shall implement demonstration projects on 22 a cost-share basis as determined by the division. Except for 23 edge-of-field practices, the state’s share of the amount shall 24 not exceed 50 percent of the estimated cost of establishing the 25 practice as determined by the division or 50 percent of the 26 actual cost of establishing the practice, whichever is less. 27 (d) The demonstration projects shall be used to educate 28 other persons about the feasibility and value of establishing 29 similar water quality practices. The division shall promote 30 field day events for purposes of allowing interested persons to 31 establish water quality practices on their agricultural land. 32 (e) The division shall conduct water quality evaluations 33 within supported subwatersheds. Within a reasonable period 34 after accumulating information from such evaluations, the 35 -2- LSB 5035HB (1) 87 ec/tm 2/ 21
H.F. _____ division shall create an aggregated database of water quality 1 practices. Any information identifying a person holding a 2 legal interest in agricultural land or specific agricultural 3 land shall be a confidential record. 4 (4) The moneys appropriated in this lettered paragraph 5 shall be used to support education and outreach in a manner 6 that encourages persons who hold a legal interest in 7 agricultural land used for farming to implement water quality 8 practices, including the establishment of such practices in 9 watersheds generally, and not limited to subwatersheds or 10 high-priority watersheds. 11 (5) The moneys appropriated in this lettered paragraph 12 may be used to contract with persons to coordinate the 13 implementation of efforts provided in this paragraph. 14 (6) The moneys appropriated in this lettered paragraph 15 may be used by the department to support urban soil and water 16 conservation efforts, which may include but are not limited 17 to management practices related to bioretention, landscaping, 18 the use of permeable or pervious pavement, and soil quality 19 restoration. The moneys shall be allocated on a cost-share 20 basis as provided in chapter 161A. 21 (7) Notwithstanding any other provision of law to the 22 contrary, the department may use moneys appropriated in 23 this lettered paragraph to carry out the provisions of this 24 paragraph on a cost-share basis in combination with other 25 moneys available to the department from a state or federal 26 source. 27 (8) Not more than 10 percent of the moneys appropriated in 28 this lettered paragraph may be used for costs of administration 29 and implementation of the water quality initiative administered 30 by the soil conservation division. 31 b. H.F. _____ As a condition of receiving the appropriation provided in 1 this subsection, the department shall not expend any moneys to 2 pay an owners’ representative fee related to the repair and 3 renovation of the dome of the Iowa state capitol. 4 Of the moneys appropriated in this subsection, the 5 department shall be authorized to expend such amount as is 6 necessary for the costs of installing outdoor lighting at the 7 Iowa state capitol. 8 From any moneys appropriated in this subsection and 9 remaining upon completion of the repair and renovation of the 10 dome of the Iowa state capitol, the department shall expend 11 such amount as is necessary for maintenance projects for 12 the Iowa state capitol and the Ola Babcock Miller building. 13 However, any unencumbered or unobligated moneys made from an 14 appropriation in this subsection and remaining at the close of 15 the fiscal year beginning July 1, 2017, shall be deposited in 16 the state capitol maintenance fund created in section 2.12B. 17 Sec. 11. 2017 Iowa Acts, chapter 173, is amended by adding 18 the following new section: 19 NEW SECTION . 4A. REVERSION. For purposes of section 20 8.33, unless specifically provided otherwise, unencumbered or 21 unobligated moneys made from an appropriation in section 4 22 shall not revert but shall remain available for expenditure for 23 the purposes designated until the close of the fiscal year that 24 ends three years after the end of the fiscal year for which the 25 appropriation is made. However, if the project or projects for 26 which such appropriation was made are completed in an earlier 27 fiscal year, unencumbered or unobligated moneys shall revert at 28 the close of that same fiscal year. 29 Sec. 12. EFFECTIVE DATE. This division of this Act, being 30 deemed of immediate importance, takes effect upon enactment. 31 DIVISION IV 32 MISCELLANEOUS PROVISIONS 33 Sec. 13. Section 8.57C, subsection 3, Code 2018, is amended 3 by adding the following new paragraph: 4 NEW PARAGRAPH . g. There is appropriated from the rebuild 5 Iowa infrastructure fund for the fiscal year beginning July 1, 6 2018, and ending June 30, 2019, the sum of fourteen million 7 four hundred thousand dollars to the technology reinvestment 8 fund, notwithstanding section 8.57, subsection 5, paragraph 9 “c” . 10 DIVISION V 11 MAINTENANCE FUNDS 12 Sec. 15. NEW SECTION . 2.12B State capitol maintenance fund 13 —— appropriation. 14 1. A state capitol maintenance fund is created in the state 15 treasury under the control of the legislative council. The 16 fund shall consist of all moneys appropriated to the fund. 17 2. There is appropriated from the rebuild Iowa 18 infrastructure fund for deposit in the state capitol 19 maintenance fund, for the fiscal year beginning July 1, 2018, 20 and for each fiscal year thereafter, the sum of five hundred 21 thousand dollars. 22 3. Moneys in the state capitol maintenance fund shall be 23 expended upon approval of the legislative council and used for 24 maintenance projects for the Iowa state capitol and the Ola 25 Babcock Miller building. 26 4. Notwithstanding section 12C.7, subsection 2, interest or 27 earnings on moneys deposited in the state capitol maintenance 28 fund shall be credited to the state capitol maintenance fund. 29 Notwithstanding section 8.33, moneys credited to the state 30 capitol maintenance fund shall not revert at the close of a 31 fiscal year. 32 Sec. 16. NEW SECTION . 8A.331 Routine maintenance fund —— 33 appropriation. 34 1. A routine maintenance fund is created in the state 35 -17- LSB 5035HB (1) 87 ec/tm 17/ 21
H.F. _____ treasury under the control of the department. The fund shall 1 consist of all moneys appropriated to the fund. 2 2. There is appropriated from the rebuild Iowa 3 infrastructure fund to the department for deposit in the 4 routine maintenance fund, for the fiscal year beginning July 5 1, 2018, and for each fiscal year thereafter, the sum of two 6 million dollars. 7 3. Moneys in the routine maintenance fund are appropriated 8 to the department for purposes of routine maintenance 9 projects for physical properties under the control of the 10 department. For purposes of this section, routine maintenance 11 includes regular upkeep of physical properties and recurring, 12 preventive, and ongoing maintenance necessary to delay or 13 prevent the failure of physical properties. 14 4. Notwithstanding section 12C.7, subsection 2, interest 15 or earnings on moneys deposited in the routine maintenance 16 fund shall be credited to the routine maintenance fund. 17 Notwithstanding section 8.33, moneys credited to the routine 18 maintenance fund shall not revert at the close of a fiscal 19 year. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill relates to and makes appropriations to state 24 departments and agencies from the rebuild Iowa infrastructure 25 fund and the technology reinvestment fund, and provides for 26 related matters. The bill is organized by divisions. 27 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 28 division appropriates project funding for FY 2018-2019 from 29 the rebuild Iowa infrastructure fund for projects for the 30 departments of agriculture and land stewardship, cultural 31 affairs, human services, natural resources, public defense, 32 public safety, and transportation, and for the office of the 33 chief information officer, economic development authority, 34 law enforcement academy, treasurer of state, and the judicial 35 -18- LSB 5035HB (1) 87 ec/tm 18/ 21

The division also appropriates project funding from 1 the rebuild Iowa infrastructure fund for multiple fiscal years 2 to the department of administrative services and the board of 3 regents. 4 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This division 5 appropriates project funding for FY 2018-2019 from the 6 technology reinvestment fund for the departments of education, 7 human rights, management, public health, homeland security and 8 emergency management, public safety, and natural resources, 9 and for the office of the chief information officer, the 10 state public defender, judicial branch, and board of parole. 11 This division also appropriates project funding for multiple 12 fiscal years beginning in FY 2018-2019 from the technology 13 reinvestment fund to the department of human services and the 14 secretary of state. 15 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. This 16 division makes a change to moneys appropriated from the rebuild 17 Iowa infrastructure fund to the board of regents for a project 18 at the state university of Iowa and for projects at the Iowa 19 state university of science and technology, and the state 20 fair authority to authorize reimbursement of infrastructure 21 costs incurred in the prior fiscal year. The division also 22 changes project funding for a project at the Iowa state 23 university of science and technology. The division also makes 24 a change to the reversion provision applicable to moneys 25 appropriated from the rebuild Iowa infrastructure fund to the 26 department of natural resources for FY 2014-2015, and adds a 27 reversion provision to moneys appropriated from the technology 28 reinvestment fund in the 2017 Iowa Acts. The division also 29 provides that any moneys remaining from an appropriation for 30 the repair of the dome of the Iowa state capitol at the close of 31 the fiscal year beginning July 1, 2017, shall be deposited in 32 the state capitol maintenance fund created in the bill. 33 This division takes effect upon enactment. 34 DIVISION IV —— MISCELLANEOUS PROVISIONS. H.F. _____ 8.57C, concerning the technology reinvestment fund, is amended 1 to provide that the appropriation to the fund from the general 2 fund for fiscal years beginning on or after July 1, 2018, is 3 changed to fiscal years beginning on or after July 1, 2019, and 4 to provide for an appropriation to the fund from the rebuild 5 Iowa infrastructure fund for the fiscal year beginning July 1, 6 2018, of $14.4 million. 7 DIVISION V —— MAINTENANCE FUNDS. This division creates two 8 new maintenance funds. 9 New Code section 2.12B creates a state capitol maintenance 10 fund in the state treasury under the control of the legislative 11 council. The new Code section provides an annual standing 12 appropriation of $500,000 from the rebuild Iowa infrastructure 13 fund for deposit in the new fund beginning in FY 2018-2019. 14 Moneys in the state capitol maintenance fund shall be 15 expended upon approval of the legislative council and used for 16 maintenance projects at the Iowa state capitol and the Ola 17 Babcock Miller building. The bill provides that interest or 18 earnings on moneys deposited in the fund shall be credited to 19 the fund and moneys credited to the fund shall not revert at 20 the close of a fiscal year. 21 New Code section 8A.331 creates a routine maintenance fund 22 in the state treasury under the control of the department of 23 administrative services. The new Code section provides an 24 annual standing appropriation of $2 million from the rebuild 25 Iowa infrastructure fund for deposit in the new fund beginning 26 in FY 2018-2019.
