H.F. _____ Section 1. Section 28E.2, subsection 2, Code 2018, is 1 amended to read as follows: 2 2. “Public agency” shall mean any political subdivision of 3 this state; any agency of the state government or of the United 4 States; and any political subdivision of another state ; and any 5 federally recognized Indian tribe . 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 This bill defines a public agency for purposes of allowing 10 the joint exercise of governmental powers under Code chapter 11 28E to include any federally recognized Indian tribe. The 12 definition of public agency in Code section 28E.2 is also made 13 applicable to Code chapter 28F concerning the joint financing 14 of public works and facilities, Code section 256B.6 relating 15 to special education, Code section 261I.8 relating to fiscal 16 agents for certain moneys administered by the Early childhood 17 Iowa area board, Code section 455B.301 providing definitions 18 relating to solid waste disposal under the department of 19 natural resources, Code chapter 717F relating to dangerous wild 20 animals, and Code section 904.308 relating to joint use of 21 facilities by the department of corrections. 22 -1- LSB 6145YC (1) 87 ec/rj 1/ 1
