Section 232.52, subsection 2, paragraph e, 1 unnumbered paragraph 1, Code 2018, is amended to read as 2 follows: 3 An order transferring the guardianship custody of the child, 4 subject to the continuing jurisdiction and custody of the 5 court for the purposes of section 232.54 , to the director of 6 the department of human services for purposes of placement in 7 the state training school or other facility, provided that the 8 child is at least twelve years of age and the court finds the 9 placement to be in the best interests of the child or necessary 10 for the protection of the public, and that the child has been 11 found to have committed an act which is a forcible felony, as 12 defined in section 702.11 , or a felony violation of section 13 124.401 or chapter 707 , or the court finds any three of the 14 following conditions exist: 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 Under current law, a court may enter a dispositional order 19 for a child adjudicated to have committed a delinquent act 20 transferring the guardianship of the child to the director of 21 the department of human services for the purpose of placing 22 the child in the state training school or other facility. 23 This bill amends current law to provide a court may enter a 24 dispositional order transferring the custody of the child 25 to the director of the department of human services for the 26 purpose of placing the child in the state training school or 27 other facility. 28 -1- LSB 5306XD (1) 87 hb/rh 1/ 1
