H.F. _____ Section 1. Section 124.308, Code 2018, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 7. a. A practitioner shall not issue a 3 prescription for more than a seven-day supply of an opiate that 4 is a schedule II controlled substance. 5 b. This subsection shall not apply to any of the following: 6 (1) A prescription issued to a patient suffering from 7 chronic pain diagnosed by a practitioner. 8 (2) A prescription issued to a patient receiving services 9 from a hospice program as defined in section 135J.1. 10 (3) A prescription issued to a patient receiving inpatient 11 hospital care. 12 (4) A prescription issued to a patient receiving inpatient 13 care in a nursing facility as defined in section 135C.1. 14 (5) A prescription issued to a patient receiving 15 end-of-life care directed at managing symptoms associated with 16 the final stages of illness and dying. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill prohibits practitioners from issuing prescriptions 21 for more than a seven-day supply of an opiate that is a 22 schedule II controlled substance. The bill makes exceptions 23 for patients suffering from chronic pain, receiving end-of-life 24 care, or receiving treatment in a hospice program, hospital, 25 or nursing facility. A practitioner who dispenses an opiate 26 that is a schedule II controlled substance in violation of the 27 bill is guilty of an aggravated misdemeanor pursuant to Code 28 section 124.402. An aggravated misdemeanor is punishable by 29 confinement for no more than two years and a fine of at least 30 $625 but not more than $6,250. 31 -1- LSB 5451YC (3) 87 ss/rh 1/ 1
