AGRICULTURAL EDUCATION. 27 1. The moneys appropriated in subsection 1 shall be used for 16 the public purpose of providing a grant to a national nonprofit 17 organization with over 80 years of experience in assisting 18 children and adults with disabilities and special needs. The 19 moneys shall be used to support a nationally recognized program 20 that began in 1986 and has been replicated in at least 30 other 21 states, but which is not available through any other entity 22 in this state, and that provides assistance to farmers with 23 disabilities in all 99 counties to allow the farmers to remain 24 in their own homes and be gainfully engaged in farming through 25 provision of agricultural worksite and home modification 26 consultations, peer support services, services to families, 27 information and referral, and equipment loan services. 28 3. Notwithstanding section 8.33 , moneys appropriated in 29 this section that remain unencumbered or unobligated at the 30 close of the fiscal year shall not revert but shall remain 31 available for expenditure for the purposes designated until the 32 close of the succeeding fiscal year. 33 DIVISION II 34 GENERAL FUND 35 -4- LSB 1047JB (4) 87 da/rn 4/ 49
S.F. _____ H.F. _____ DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 1 WATER QUALITY INITIATIVE 2 APPROPRIATIONS FOR FY 2017-2018 3 Sec. 8. WATER QUALITY INITIATIVE —— GENERAL. 4 1. There is appropriated from the general fund of the state 5 to the department of agriculture and land stewardship for the 6 fiscal year beginning July 1, 2017, and ending June 30, 2018, 7 the following amount, or so much thereof as is necessary, to be 8 used for the purposes designated: 9 For deposit in the water quality initiative fund created in 10 section 466B.45 , for purposes of supporting the water quality 11 initiative administered by the division of soil conservation 12 and water quality as provided in section 466B.42 , including 13 salaries, support, maintenance, and miscellaneous purposes: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 15 2. a. The moneys appropriated in subsection 1 shall be 16 used to support projects in subwatersheds as designated by the 17 division that are part of high-priority watersheds identified 18 by the water resources coordinating council established 19 pursuant to section 466B.3 . 20 b. The moneys appropriated in subsection 1 shall be used to 21 support projects in watersheds generally, including regional 22 watersheds, as designated by the division and high-priority 23 watersheds identified by the water resources coordinating 24 council established pursuant to section 466B.3. 25 3. In supporting projects in subwatersheds and watersheds 26 as provided in subsection 2, all of the following shall apply: 27 a. The demonstration projects shall utilize water quality 28 practices as described in the latest revision of the document 29 entitled “Iowa Nutrient Reduction Strategy” initially presented 30 in November 2012 by the department of agriculture and land 31 stewardship, the department of natural resources, and Iowa 32 state university of science and technology. 33 b. The division shall implement demonstration projects as 34 provided in paragraph “a” by providing for participation by 35 -5- LSB 1047JB (4) 87 da/rn 5/ 49
S.F. _____ H.F. _____ persons who hold a legal interest in agricultural land used in 1 farming. To every extent practical, the division shall provide 2 for collaborative participation by such persons who hold a 3 legal interest in agricultural land located within the same 4 subwatershed. 5 c. The division shall implement a demonstration project on 6 a cost-share basis as determined by the division. However, the 7 state’s share of the amount shall not exceed 50 percent of the 8 estimated cost of establishing the practice as determined by 9 the division or 50 percent of the actual cost of establishing 10 the practice, whichever is less. 11 d. The demonstration projects shall be used to educate other 12 persons about the feasibility and value of establishing similar 13 water quality practices. The division shall promote field day 14 events for purposes of allowing interested persons to establish 15 water quality practices on their agricultural land. 16 e. The division shall conduct water quality evaluations 17 within supported subwatersheds. Within a reasonable period 18 after accumulating information from such evaluations, the 19 division shall create an aggregated database of water quality 20 practices. Any information identifying a person holding a 21 legal interest in agricultural land or specific agricultural 22 land shall be a confidential record under section 22.7 . 23 4. The moneys appropriated in subsection 1 shall be used 24 to support education and outreach in a manner that encourages 25 persons who hold a legal interest in agricultural land used for 26 farming to implement water quality practices, including the 27 establishment of such practices in watersheds generally, and 28 not limited to subwatersheds or high-priority watersheds. 29 5. The moneys appropriated in subsection 1 may be used 30 to contract with persons to coordinate the implementation of 31 efforts provided in this section. 32 6. The moneys appropriated in subsection 1 may be used by 33 the department to support urban soil and water conservation 34 efforts, which may include but are not limited to management 35 -6- LSB 1047JB (4) 87 da/rn 6/ 49
S.F. _____ H.F. _____ practices related to bioretention, landscaping, the use of 1 permeable or pervious pavement, and soil quality restoration. 2 The moneys shall be allocated on a cost-share basis as provided 3 in chapter 161A. 4 7. Notwithstanding any other provision of law to the 5 contrary, the department may use moneys appropriated in 6 subsection 1 to carry out the provisions of this section on a 7 cost-share basis in combination with other moneys available to 8 the department from a state or federal source. 9 8. Not more than 10 percent of the moneys appropriated in 10 this section may be used to pay for the costs of administering 11 and implementing the water quality initiative by the 12 department’s division of soil conservation and water quality as 13 provided in section 466B.42 and this section. 14 DIVISION III 15 DEPARTMENT OF NATURAL RESOURCES 16 GENERAL APPROPRIATIONS FOR FY 2017-2018 17 Sec. 9. GENERAL FUND —— DEPARTMENT. 18 1. There is appropriated from the state fish and game 13 protection fund to the department of natural resources for the 14 fiscal year beginning July 1, 2017, and ending June 30, 2018, 15 the following amount, or so much thereof as is necessary, to be 16 used for the purposes designated: 17 For purposes of supporting the regulation or advancement of 18 hunting, fishing, or trapping, or the protection, propagation, 19 restoration, management, or harvest of fish or wildlife, 20 including for administration, regulation, law enforcement, and 21 programs; and for salaries, support, maintenance, equipment, 22 and miscellaneous purposes: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 43,147,993 24 2. Paragraph “a” does not apply to a reduction made to 23 support the college of veterinary medicine, if the same 24 percentage of reduction imposed on the college of veterinary 25 medicine is also imposed on all of Iowa state university of 26 science and technology’s budget units. 27 3. The allocation of moneys as financial incentives as 28 provided in section 161A.73 may be used in combination with 29 moneys allocated by the department of natural resources. 30 i. Not more than 15 percent of the moneys appropriated 31 in paragraph “c” may be used for costs of administration and 32 implementation of soil and water conservation practices. 33 j. Subsection 1 does not apply to moneys transferred 3 pursuant to this division to the hungry canyons account of 4 the loess hills development and conservation fund created in 5 section 161D.2 which shall not revert as provided in that 6 section. 7 DIVISION VI 8 ENVIRONMENT FIRST FUND 9 SPECIAL APPROPRIATIONS FOR FY 2017-2018 10 Sec. 20. WATER QUALITY INITIATIVE —— DEPARTMENT OF 11 AGRICULTURE AND LAND STEWARDSHIP. 12 1. There is appropriated from the environment first fund 13 created in section 8.57A to the department of agriculture 14 and land stewardship for the fiscal year beginning July 1, 15 2017, and ending June 30, 2018, the following amount, or so 16 much thereof as is necessary, to be used for the purposes 17 designated: 18 For deposit in the water quality initiative fund created in 19 section 466B.45 , for purposes of supporting the water quality 20 initiative administered by the division of soil conservation 21 and water quality as provided in section 466B.42 , including 22 salaries, support, maintenance, and miscellaneous purposes: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,375,000 24 2. a. The moneys appropriated in subsection 1 shall be 25 used to support projects in subwatersheds as designated by the 26 division that are part of high-priority watersheds identified 27 by the water resources coordinating council established 28 pursuant to section 466B.3 . 29 b. The moneys appropriated in subsection 1 shall be used to 30 support projects in watersheds generally, including regional 31 watersheds, as designated by the division and high-priority 32 watersheds identified by the water resources coordinating 33 council established pursuant to section 466B.3. 34 3. In supporting projects in subwatersheds and watersheds 35 -17- LSB 1047JB (4) 87 da/rn 17/ 49
S.F. _____ H.F. _____ as provided in subsection 2, all of the following shall apply: 1 a. The demonstration projects shall utilize water quality 2 practices as described in the latest revision of the document 3 entitled “Iowa Nutrient Reduction Strategy” initially presented 4 in November 2012 by the department of agriculture and land 5 stewardship, the department of natural resources, and Iowa 6 state university of science and technology. 7 b. The division shall implement demonstration projects as 8 provided in paragraph “a” by providing for participation by 9 persons who hold a legal interest in agricultural land used in 10 farming. To every extent practical, the division shall provide 11 for collaborative participation by such persons who hold a 12 legal interest in agricultural land located within the same 13 subwatershed. 14 c. The division shall implement a demonstration project on 15 a cost-share basis as determined by the division. However, the 16 state’s share of the amount shall not exceed 50 percent of the 17 estimated cost of establishing the practice as determined by 18 the division or 50 percent of the actual cost of establishing 19 the practice, whichever is less. 20 d. The demonstration projects shall be used to educate other 21 persons about the feasibility and value of establishing similar 22 water quality practices. The division shall promote field day 23 events for purposes of allowing interested persons to establish 24 water quality practices on their agricultural land. 25 e. The division shall conduct water quality evaluations 26 within supported subwatersheds. Within a reasonable period 27 after accumulating information from such evaluations, the 28 division shall create an aggregated database of water quality 29 practices. Any information identifying a person holding a 30 legal interest in agricultural land or specific agricultural 31 land shall be a confidential record under section 22.7 . 32 4. The moneys appropriated in subsection 1 shall be used 33 to support education and outreach in a manner that encourages 34 persons who hold a legal interest in agricultural land used for 35 -18- LSB 1047JB (4) 87 da/rn 18/ 49
S.F. _____ H.F. _____ farming to implement water quality practices, including the 1 establishment of such practices in watersheds generally, and 2 not limited to subwatersheds or high-priority watersheds. 3 5. The moneys appropriated in subsection 1 may be used 4 to contract with persons to coordinate the implementation of 5 efforts provided in this section. 6 6. The moneys appropriated in subsection 1 may be used by 7 the department to support urban soil and water conservation 8 efforts, which may include but are not limited to management 9 practices related to bioretention, landscaping, the use of 10 permeable or pervious pavement, and soil quality restoration. 11 The moneys shall be allocated on a cost-share basis as provided 12 in chapter 161A. 13 7. Notwithstanding any other provision of law to the 14 contrary, the department may use moneys appropriated in 15 subsection 1 to carry out the provisions of this section on a 16 cost-share basis in combination with other moneys available to 17 the department from a state or federal source. 18 8. Not more than 10 percent of the moneys appropriated in 19 this section may be used to pay for the costs of administering 20 and implementing the water quality initiative by the 21 department’s division of soil conservation and water quality as 22 provided in section 466B.42 and this section. 23 Sec. 21. REAP —— IN LIEU OF GENERAL FUND APPROPRIATION. 24 Notwithstanding the standing appropriation in section 455A.18, 25 there is appropriated from the environment first fund created 26 in section 8.57A to the Iowa resources enhancement and 27 protection fund, in lieu of the appropriation made in section 28 455A.18, for the fiscal year beginning July 1, 2017, and 29 ending June 30, 2018, the following amount, to be allocated as 30 provided in section 455A.19: 31 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,000,000 32 DIVISION VII 33 ELIMINATION OF WATERSHED IMPROVEMENT REVIEW BOARD 34 SPECIAL APPROPRIATION FOR FY 2017-2018 35 -19- LSB 1047JB (4) 87 da/rn 19/ 49
S.F. _____ H.F. _____ RELATED STATUTORY CHANGES 1 Sec. 22. MANAGEMENT OF MONEYS IN THE WATERSHED IMPROVEMENT 2 FUND —— APPROPRIATION. 3 1. Notwithstanding section 466A.2, and the repeal of 4 chapter 466A as provided in this division of this Act, on and 5 after December 31, 2017, the department of agriculture and land 6 stewardship shall manage the watershed improvement fund in the 7 same manner as required in 2016 Acts, chapter 1134, section 8 35, including by making necessary payments to satisfy any 9 outstanding obligations incurred by the watershed improvement 10 review board prior to December 31, 2017. 11 2. Any unobligated and unencumbered moneys remaining in 12 the watershed improvement fund on December 31, 2017, are 13 appropriated to the department for use by the department in 14 providing for soil and water conservation administration, the 15 conservation of soil and water resources, or the support of 16 soil and water conservation districts in the same manner as 17 provided in the section of this Act appropriating moneys to the 18 department from the environment first fund created in section 19 8.57A. 20 Sec. 23. Section 461.33, subsection 2, paragraph a, Code 21 2017, is amended to read as follows: 22 a. Soil conservation and watershed protection, including by 23 supporting the division of soil conservation and water quality 24 within the department of agriculture and land stewardship 25 and soil and water conservation district commissioners. The 26 department may provide for the installation of conservation 27 practices and watershed protection improvements as provided in 28 chapters 161A , 161C , 461A , and 466 , and 466A . 29 Sec. 24. REPEAL. Chapter 466A, Code 2017, is repealed. 30 Sec. 25. EFFECTIVE DATES. 31 1. The section of this division of this Act repealing 32 chapter 466A takes effect January 1, 2018. 33 2. S.F. _____ H.F. _____ DIVISION VIII 1 IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND 2 SPECIAL USE OF MONEYS FOR FY 2017-2018 3 Sec. 26. OPEN SPACES ACCOUNT —— PARK MAINTENANCE AND 4 REPAIR. Notwithstanding section 455A.19, subsection 1, 5 paragraph “a”, subparagraph (1), of the moneys allocated to 6 the open spaces account of the Iowa resources enhancement and 7 protection fund, $288,000 shall be used by the department of 8 natural resources for state park maintenance and repair for 9 the fiscal year beginning July 1, 2017, and ending on June 30, 10 2018. 11 DIVISION IX 12 LIVESTOCK HEALTH SPECIAL APPROPRIATION FOR FY 2017-2018 13 GENERAL FUND —— RELATED STATUTORY CHANGES 14 Sec. 27. FOREIGN ANIMAL DISEASES AFFLICTING LIVESTOCK —— 15 APPROPRIATION. There is appropriated from the general fund of 16 the state to the department of agriculture and land stewardship 17 for the fiscal year beginning July 1, 2017, and ending June 30, 18 2018, the following amount, or so much thereof as is necessary, 19 to be used for the purposes designated: 20 1. For deposit in the foreign animal disease preparedness 21 and response fund created in section 163.3B as enacted in this 22 division of this Act: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 24 2. In developing a foreign animal disease preparedness and 25 response strategy as required in section 163.3C as enacted in 26 this division of this Act, the department shall prepare an 27 interim report to be submitted to the joint appropriations 28 subcommittee on agriculture and natural resources not later 29 than January 10, 2018. The interim report shall include 30 preliminary findings and recommendations together with plans 31 for completing the strategy. The department shall prepare 32 a final report to be submitted to the joint appropriations 33 subcommittee on agriculture and natural resources not later 34 than January 10, 2019. S.F. _____ H.F. _____ findings and recommendations for establishing the strategy, 1 and may include any proposed notice of intended action for 2 consideration by the department or proposed legislation for 3 consideration by the general assembly. 4 Sec. 28. NEW SECTION . 163.3B Foreign animal disease 5 preparedness and response fund. 6 1. A foreign animal disease preparedness and response 7 fund is created in the state treasury under the control and 8 management of the department. 9 2. The fund shall include moneys appropriated by the general 10 assembly credited to the fund. The fund may include other 11 moneys available to and obtained or accepted by the department 12 as provided in section 159.6A, including but not limited to the 13 federal government, other public sources, or private sources. 14 3. Moneys in the fund are appropriated to the department and 15 shall be used exclusively to develop, establish, and implement 16 a foreign animal disease preparedness and response strategy 17 as described in section 163.3C, and shall not require further 18 special authorization by the general assembly. 19 4. a. Notwithstanding section 12C.7, interest or earnings 20 on moneys in the fund shall be credited to the fund. 21 b. Notwithstanding section 8.33, moneys credited to the fund 22 that remain unexpended or unobligated at the end of a fiscal 23 year shall not revert to any other fund. 24 Sec. 29. NEW SECTION . 163.3C Foreign animal disease 25 preparedness and response strategy. 26 1. As used in this section, unless the context otherwise 27 requires: 28 a. “Foreign animal disease” means a disease introduced into 29 this state that negatively affects the health of livestock 30 and is transmittable between the same or different species of 31 livestock. 32 b. “Livestock” means an animal belonging to the bovine, 33 caprine, equine, ovine, or porcine species, ostriches, rheas, 34 emus; farm deer as defined in section 170.1; or turkeys, 35 -22- LSB 1047JB (4) 87 da/rn 22/ 49
S.F. _____ H.F. _____ chickens, or other poultry. 1 2. The department shall develop and establish a foreign 2 animal disease preparedness and response strategy for use by 3 the department in order to prevent, control, or eradicate the 4 transmission of foreign animal diseases among populations 5 of livestock. The strategy may be part of the department’s 6 veterinary emergency preparedness and response services 7 as provided in section 163.3A. The strategy shall provide 8 additional expertise and resources to increase biosecurity 9 efforts that assist in the prevention of a foreign animal 10 disease outbreak in this state. In developing and establishing 11 the strategy, the department shall consult with interested 12 persons including but not limited to the following: 13 a. The Iowa cattlemen’s association. 14 b. The Iowa state dairy association. 15 c. The Iowa pork producers association. 16 d. The Iowa sheep producers industry association. 17 e. The Iowa turkey federation. 18 f. The Iowa poultry association. 19 g. The college of veterinary medicine at Iowa state 20 university. 21 h. The livestock health advisory council created in section 22 267.2. 23 3. The department shall implement the foreign animal 24 disease preparedness and response strategy if necessary 25 to prevent, control, or eradicate the transmission and 26 incidence of foreign animal diseases that may threaten or 27 actually threaten livestock in this state. In implementing 28 the strategy, the department may utilize emergency response 29 measures as otherwise required under section 163.3A. The 30 department may but is not required to consult with interested 31 persons when implementing the strategy. 32 DIVISION X 33 APPROPRIATION AND STATUTORY CHANGES —— ELIMINATION 34 OF LEOPOLD CENTER FOR SUSTAINABLE AGRICULTURE 35 -23- LSB 1047JB (4) 87 da/rn 23/ 49
S.F. _____ H.F. _____ Sec. 30. Section 266.39A, Code 2017, is amended to read as 1 follows: 2 266.39A Agricultural research. 3 Iowa state university of science and technology shall 4 conduct continuing agricultural research to provide information 5 about environmental and social impacts of agricultural research 6 on the small or family farm and information about population 7 trends and impact of the trends on Iowa agriculture , in 8 addition to research that may include the categories specified 9 in section 266.39B, subsection 2 . The research shall include 10 an agricultural land tenure study conducted every five years to 11 determine the ownership of farmland, and to analyze ownership 12 trends, using the categories of land ownership defined in 13 chapter 9H . The study shall be conducted on the basis of 14 regions established by the university. A region shall be 15 composed of not more than twenty-three contiguous counties. 16 Sec. 31. Section 455E.11, subsection 2, paragraph b, 17 subparagraph (3), subparagraph division (a), Code 2017, is 18 amended to read as follows: 19 (a) Thirty-five percent is appropriated annually for 20 the Leopold center for sustainable agriculture at Iowa state 21 university of science and technology to the Iowa nutrient 22 research fund created in section 466B.46 . 23 Sec. 32. Section 466B.46, subsection 2, Code 2017, is 24 amended by adding the following new paragraph: 25 NEW PARAGRAPH . 0b. Moneys appropriated from the agriculture 26 management account of the groundwater protection fund pursuant 27 to section 455E.11, subsection 2, paragraph “b” , subparagraph 28 (3), subparagraph division (a). 29 Sec. 33. ONGOING ACTIVITIES AND EXPENSES. 30 1. Until July 1, 2017, the Leopold center for sustainable 31 agriculture established in section 266.39 shall not initiate 32 any new activity that otherwise could be conducted under 33 section 266.39 or 266.39B, including but not limited to 34 research grants and projects. The Leopold center for 35 -24- LSB 1047JB (4) 87 da/rn 24/ 49
S.F. _____ H.F. _____ sustainable agriculture shall not incur any obligation or 1 expense unless approved by the college of agriculture and life 2 sciences at Iowa state university of science and technology. 3 The Leopold center for sustainable agriculture shall cancel 4 any existing grant or project that is not in the process of 5 being immediately completed. However, the Leopold center 6 for sustainable agriculture shall not cancel a grant or 7 project that would result in a default of a legal or equitable 8 obligation, including breach of contract. 9 2. On and after July 1, 2017, the college of agriculture 10 and life sciences at Iowa state university of science and 11 technology shall administer any ongoing activity that the 12 Leopold center for sustainable agriculture had administered 13 under section 266.39 or 266.39B prior to that date. The 14 college may expend moneys appropriated from the Iowa nutrient 15 research fund created in section 466B.46 in order to pay for 16 any necessary expenses associated with the Leopold center 17 for sustainable agriculture and for completing any ongoing 18 activity. The college shall cancel any existing grant 19 or project that is not in the process of being completed. 20 However, the college shall not cancel a grant or project that 21 would result in a default of a legal or equitable obligation, 22 including breach of contract. The college shall submit a 23 report to the general assembly by January 10, 2018, which 24 shall include a summary of the ongoing activities and expenses 25 described in this section and the expected completion date of 26 those activities and expenses. 27 Sec. 34. REPEAL. Sections 266.39 and 266.39B, Code 2017, 28 are repealed. 29 Sec. 35. EFFECTIVE DATES. 30 1. The section of this division of this Act providing for 31 ongoing activities and expenses, being deemed of immediate 32 importance, takes effect upon enactment. 33 2. The 19 moneys shall be used to support a nationally recognized program 20 that began in 1986 and has been replicated in at least 30 other 21 states, but which is not available through any other entity 22 in this state, and that provides assistance to farmers with 23 disabilities in all 99 counties to allow the farmers to remain 24 in their own homes and be gainfully engaged in farming through 25 provision of agricultural worksite and home modification 26 consultations, peer support services, services to families, 27 information and referral, and equipment loan services. 28 3. The moneys appropriated in subsection 1 shall be 16 used to support projects in subwatersheds as designated by the 17 division that are part of high-priority watersheds identified 18 by the water resources coordinating council established 19 pursuant to section 466B.3 . 20 b. The moneys appropriated in subsection 1 shall be used to 21 support projects in watersheds generally, including regional 22 watersheds, as designated by the division and high-priority 23 watersheds identified by the water resources coordinating 24 council established pursuant to section 466B.3. 25 3. In supporting projects in subwatersheds and watersheds 26 as provided in subsection 2, all of the following shall apply: 27 a. The demonstration projects shall utilize water quality 28 practices as described in the latest revision of the document 29 entitled “Iowa Nutrient Reduction Strategy” initially presented 30 in November 2012 by the department of agriculture and land 31 stewardship, the department of natural resources, and Iowa 32 state university of science and technology. 33 b. The division shall implement demonstration projects as 34 provided in paragraph “a” by providing for participation by 35 -30- LSB 1047JB (4) 87 da/rn 30/ 49
S.F. _____ H.F. _____ persons who hold a legal interest in agricultural land used in 1 farming. To every extent practical, the division shall provide 2 for collaborative participation by such persons who hold a 3 legal interest in agricultural land located within the same 4 subwatershed. 5 c. The division shall implement a demonstration project on 6 a cost-share basis as determined by the division. However, the 7 state’s share of the amount shall not exceed 50 percent of the 8 estimated cost of establishing the practice as determined by 9 the division or 50 percent of the actual cost of establishing 10 the practice, whichever is less. 11 d. The demonstration projects shall be used to educate other 12 persons about the feasibility and value of establishing similar 13 water quality practices. The division shall promote field day 14 events for purposes of allowing interested persons to establish 15 water quality practices on their agricultural land. 16 e. The division shall conduct water quality evaluations 17 within supported subwatersheds. Within a reasonable period 18 after accumulating information from such evaluations, the 19 division shall create an aggregated database of water quality 20 practices. Any information identifying a person holding a 21 legal interest in agricultural land or specific agricultural 22 land shall be a confidential record under section 22.7 . 23 4. The moneys appropriated in subsection 1 shall be used 24 to support education and outreach in a manner that encourages 25 persons who hold a legal interest in agricultural land used for 26 farming to implement water quality practices, including the 27 establishment of such practices in watersheds generally, and 28 not limited to subwatersheds or high-priority watersheds. 29 5. The moneys appropriated in subsection 1 may be used 30 to contract with persons to coordinate the implementation of 31 efforts provided in this section. 32 6. The moneys appropriated in subsection 1 may be used by 33 the department to support urban soil and water conservation 34 efforts, which may include but are not limited to management 35 -31- LSB 1047JB (4) 87 da/rn 31/ 49
S.F. _____ H.F. _____ practices related to bioretention, landscaping, the use of 1 permeable or pervious pavement, and soil quality restoration. 2 The moneys shall be allocated on a cost-share basis as provided 3 in chapter 161A. 4 7. Notwithstanding any other provision of law to the 5 contrary, the department may use moneys appropriated in 6 subsection 1 to carry out the provisions of this section on a 7 cost-share basis in combination with other moneys available to 8 the department from a state or federal source. 9 8. Not more than 10 percent of the moneys appropriated in 10 this section may be used to pay for the costs of administering 11 and implementing the water quality initiative by the 12 department’s division of soil conservation and water quality as 13 provided in section 466B.42 and this section. 14 DIVISION XIII 15 DEPARTMENT OF NATURAL RESOURCES 16 GENERAL APPROPRIATIONS FOR FY 2018-2019 17 Sec. 44. REVERSION. 14 1. a. The moneys appropriated in subsection 1 shall be 19 used to support projects in subwatersheds as designated by the 20 division that are part of high-priority watersheds identified 21 by the water resources coordinating council established 22 pursuant to section 466B.3 . 23 b. The moneys appropriated in subsection 1 shall be used to 24 support projects in watersheds generally, including regional 25 watersheds, as designated by the division and high-priority 26 watersheds identified by the water resources coordinating 27 council established pursuant to section 466B.3. 28 3. In supporting projects in subwatersheds and watersheds 29 as provided in subsection 2, all of the following shall apply: 30 a. The demonstration projects shall utilize water quality 31 practices as described in the latest revision of the document 32 entitled “Iowa Nutrient Reduction Strategy” initially presented 33 in November 2012 by the department of agriculture and land 34 stewardship, the department of natural resources, and Iowa 35 -42- LSB 1047JB (4) 87 da/rn 42/ 49

The division shall implement demonstration projects as 2 provided in paragraph “a” by providing for participation by 3 persons who hold a legal interest in agricultural land used in 4 farming. To every extent practical, the division shall provide 5 for collaborative participation by such persons who hold a 6 legal interest in agricultural land located within the same 7 subwatershed. 8 c. The division shall implement a demonstration project on 9 a cost-share basis as determined by the division. However, the 10 state’s share of the amount shall not exceed 50 percent of the 11 estimated cost of establishing the practice as determined by 12 the division or 50 percent of the actual cost of establishing 13 the practice, whichever is less. 14 d. The demonstration projects shall be used to educate other 15 persons about the feasibility and value of establishing similar 16 water quality practices. The division shall promote field day 17 events for purposes of allowing interested persons to establish 18 water quality practices on their agricultural land. 19 e. The division shall conduct water quality evaluations 20 within supported subwatersheds. Within a reasonable period 21 after accumulating information from such evaluations, the 22 division shall create an aggregated database of water quality 23 practices. Any information identifying a person holding a 24 legal interest in agricultural land or specific agricultural 25 land shall be a confidential record under section 22.7 . 26 4. The moneys appropriated in subsection 1 shall be used 27 to support education and outreach in a manner that encourages 28 persons who hold a legal interest in agricultural land used for 29 farming to implement water quality practices, including the 30 establishment of such practices in watersheds generally, and 31 not limited to subwatersheds or high-priority watersheds. 32 5. The moneys appropriated in subsection 1 may be used 33 to contract with persons to coordinate the implementation of 34 efforts provided in this section. 35 -43- LSB 1047JB (4) 87 da/rn 43/ 49

The moneys appropriated in subsection 1 may be used by 1 the department to support urban soil and water conservation 2 efforts, which may include but are not limited to management 3 practices related to bioretention, landscaping, the use of 4 permeable or pervious pavement, and soil quality restoration. 5 The moneys shall be allocated on a cost-share basis as provided 6 in chapter 161A. 7 7. Notwithstanding any other provision of law to the 8 contrary, the department may use moneys appropriated in 9 subsection 1 to carry out the provisions of this section on a 10 cost-share basis in combination with other moneys available to 11 the department from a state or federal source. 12 8. Not more than 10 percent of the moneys appropriated in 13 this section may be used to pay for the costs of administering 14 and implementing the water quality initiative by the 15 department’s division of soil conservation and water quality as 16 provided in section 466B.42 and this section. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 GENERAL. This bill relates to agriculture and natural 21 resources by making appropriations for the fiscal years 22 2017-2018 and 2018-2019 to support related entities, including 23 the department of agriculture and land stewardship (DALS), 24 the department of natural resources (DNR), and Iowa state 25 university (ISU). 26 The bill primarily appropriates moneys to DALS and DNR. 27 The appropriations are made to support those departments for 28 administration, regulation, and support of programs. The bill 29 requires the departments to submit quarterly reports to the 30 general assembly and department of management regarding the 31 expenditure of appropriated moneys. The bill also provides 32 moneys to support specific programs or projects administered by 33 those departments. The bill appropriates moneys from a number 34 of sources, including the general fund of the state (general 35 -44- LSB 1047JB (4) 87 da/rn 44/ 49
S.F. _____ H.F. _____ fund), the state fish and game protection fund, the groundwater 1 protection fund (Code section 455E.11), and the environment 2 first fund (EFF) (Code section 8.57A). Special appropriations 3 are made from the open spaces account of the Iowa resources 4 enhancement and protection fund (REAP) (Code sections 455A.18 5 and 455A.19). Appropriations are made from a number of sources 6 to support the water quality initiative (WQI) (Code chapter 7 466B). The bill is organized into divisions. 8 DALS —— GENERAL FUND APPROPRIATIONS —— FY 2017-2018. The 9 bill appropriates moneys to DALS from the general fund for FY 10 2017-2018 in order to support its administrative divisions, 11 including consumer protection and industry services, soil 12 conservation, and food safety and animal health. Moneys are 13 transferred to ISU to support its midwest grape and wine 14 institute. 15 DALS —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS 16 —— FY 2017-2018. The bill appropriates moneys from several 17 sources for FY 2017-2018 to support a number of designated 18 purposes, including moneys derived from unclaimed winnings from 19 horse and dog races, for administration and enforcement of 20 racing regulations (Code section 99D.22); and moneys credited 21 to the renewable fuel infrastructure fund (Code section 22 159A.16), for purposes of motor fuel inspection and auditing 23 biofuel processing and production (Code chapter 214A). 24 DALS —— SPECIAL GENERAL FUND APPROPRIATIONS —— FY 2017-2018. 25 The bill also makes special appropriations from the general 26 fund for FY 2017-2018 to DALS in order to support specific 27 purposes including milk inspection (Code section 192.109), 28 the local food and farm program (Code chapter 267A), an 29 agricultural education organization, and assistance to farmers 30 with disabilities. 31 DALS —— GENERAL FUND APPROPRIATIONS —— WQI —— FY 2017-2018. 32 The bill appropriates moneys from the general fund for FY 33 2017-2018 to DALS for deposit in the water quality initiative 34 fund (Code section 466B.45), to support the WQI including 35 -45- LSB 1047JB (4) 87 da/rn 45/ 49

The bill appropriates moneys for FY 2017-2018 to 10 DNR from a number of sources to support designated purposes, 11 including moneys deposited in the special snowmobile fund 12 (Code section 321G.7) to provide for administering and 13 enforcing the state snowmobile programs; and moneys deposited 14 in the unassigned revenue fund for purposes of paying for 15 administration of DNR’s underground storage tanks section. 16 DNR —— SPECIAL GENERAL FUND APPROPRIATIONS —— FY 2017-2018. 17 The bill also makes special appropriations from the general 18 fund for FY 2017-2018 to DNR in order to support specific 19 purposes including floodplain management and dam safety and 20 forestry health management programs. 21 ISU —— SPECIAL GENERAL FUND APPROPRIATIONS —— FY 2017-2018. 22 The bill appropriates moneys from the general fund for FY 23 2017-2018 to ISU to support the operation of its veterinary 24 diagnostic laboratory. 25 DALS AND DNR —— EFF —— GENERAL APPROPRIATIONS —— FY 26 2017-2018. The bill appropriates moneys from the EFF for FY 27 2017-2018 to support a number of programs administered by DALS 28 and DNR. For DALS, the moneys are appropriated to support 29 programs involving soil conservation, watershed protection 30 and nutrient management, and the loess hills development and 31 conservation fund (Code section 161D.2). For DNR, moneys 32 are appropriated to support programs involving state parks, 33 geographic information systems, water quality monitoring, 34 public water supplies, regulation of animal feeding operations, 35 -46- LSB 1047JB (4) 87 da/rn 46/ 49

Moneys are appropriated to the water quality 6 initiative fund subject to the same conditions applicable to 7 moneys appropriated to the fund from the general fund. Moneys 8 are appropriated to support REAP from the EFF in lieu of the 9 general fund. 10 DALS —— WATERSHED IMPROVEMENT FUND —— ADMINISTRATION 11 AND RELATED STATUTORY CHANGES TO ELIMINATE THE WATERSHED 12 IMPROVEMENT REVIEW BOARD. The bill eliminates powers, duties, 13 and funding for the watershed improvement review board. DALS 14 is required to manage the watershed improvement fund and make 15 necessary payments to satisfy outstanding obligations incurred 16 by the board prior to December 31, 2017. Any unobligated and 17 unencumbered moneys remaining in the fund are appropriated to 18 DALS to support soil conservation efforts. 19 DNR —— OPEN SPACES ACCOUNT OF REAP —— PARK MAINTENANCE AND 20 REPAIR —— FY 2017-2018. A portion of moneys allocated to 21 REAP’s open spaces account are to be used by DNR for state park 22 maintenance and repair. 23 DALS —— GENERAL FUND —— LIVESTOCK HEALTH AND RELATED 24 STATUTORY CHANGES —— FY 2017-2018. The bill appropriates 25 moneys to DALS for purposes of developing a foreign animal 26 disease preparedness and response strategy and for the possible 27 implementation of that strategy. The bill makes a number of 28 statutory changes including the establishment of a foreign 29 animal disease preparedness and response fund. 30 ISU —— ELIMINATION OF LEOPOLD CENTER FOR SUSTAINABLE 31 AGRICULTURE FY 2017-2018. The bill eliminates ISU’s Leopold 32 center for sustainable agriculture. ISU’s college of 33 agriculture and life sciences is to oversee the process 34 of winding up the center’s affairs.
