1.
NEW
SECTION
.
217.45
Background
investigations.
1
1.
A
background
investigation
shall
be
conducted
by
2
the
department
of
human
services
on
all
of
the
following
3
individuals:
4
a.
An
applicant
for
employment
with
the
department.
5
b.
A
contractor,
vendor,
or
employee
performing
work
for
6
the
department
with
access
to
federal
and
state
income
tax
7
information
of
applicants
or
participants
in
state
assistance
8
programs
administered
by
the
department.
9
2.
An
individual
subject
to
this
section
shall
authorize
the
10
release
of
the
results
of
all
of
the
following:
11
a.
A
work
history.
12
b.
A
state
criminal
history
background
check.
The
13
individual
shall
provide
fingerprints
to
the
department
for
14
this
purpose.
15
c.
A
national
criminal
history
check
through
the
federal
16
bureau
of
investigation.

3.
The
department
shall
pay
the
actual
cost
of
the
18
fingerprinting
and
the
national
criminal
history
check,
if
any,
19
unless
otherwise
agreed
to
as
part
of
a
vendor
contract
or
20
other
contract
with
the
department.

4.
A
contractor,
vendor,
or
employee
performing
work
for
the
22
department
shall
be
subject
to
a
background
investigation
by
23
the
department
at
least
once
every
ten
years
after
the
date
of
24
the
initial
contract
with
the
contractor
or
vendor
or
initial
25
date
of
hire
of
the
employee.

5.
The
results
of
background
investigations
conducted
27
pursuant
to
this
section
shall
not
be
considered
public
records
28
under
chapter
22.

EXPLANATION
30
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
31
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
background
investigations
conducted
33
by
the
department
of
human
services.
The
bill
provides
34
that
a
background
investigation
shall
be
conducted
by
the

an
applicant
for
employment
with
the
department,

and
a
contractor,
vendor,
or
employee
performing
work
for

the
department
with
access
to

department.
The
department
5
shall
pay
for
the
cost
of
the
background
investigations

unless
otherwise
agreed
to

a
vendor

work

the
department
shall
be

to

investigation

The

the

investigations
