NEW SECTION . 483A.1B License fees —— periodic 20 evaluation. 21 1. The license fees established in section 483A.1 shall be 22 periodically evaluated by the department, but not less often 23 than once every three years to ensure that the fees paid are 24 sufficient to meet the needs of natural resource management and 25 the public. 26 2. By December 15 of each year that an evaluation of the 27 license fees is completed, the department shall file a written 28 report with the commission which shall include the findings of 29 the evaluation and recommendations, if any. 30 Sec. 3. Section 483A.3, subsection 1, paragraphs c and d, 31 Code 2017, are amended to read as follows: 32 c. Eleven Fifteen dollars of the fee paid for each resident 33 or nonresident hunting or fur harvester license that includes 34 the wildlife habitat fee and twenty dollars of the fee paid for 35 -5- LSB 1477YC (3) 87 av/nh 5/ 12
H.F. _____ each nonresident hunting or fur harvester license that includes 1 the wildlife habitat fee shall be designated as a wildlife 2 habitat fee. 3 d. All wildlife habitat fees shall be administered in 4 the same manner as hunting and fur harvester licenses except 5 all revenue derived from wildlife habitat fees shall be used 6 within the state of Iowa for habitat development and shall be 7 deposited in the state fish and game protection fund, except 8 as provided in subsection 2 . The revenue may be used for 9 the matching of federal funds. The revenues and any matched 10 federal funds shall be used for acquisition of land, leasing of 11 land, or obtaining of easements from willing sellers for use 12 as wildlife habitats. Notwithstanding the exemption provided 13 by section 427.1 , any land acquired with the revenues and 14 matched federal funds shall be subject to the full consolidated 15 levy of property taxes , which shall be paid from those the 16 income generated from those lands or, if no such income is 17 generated, from the wildlife habitat fee revenues. In addition 18 the revenue may be used for the development and enhancement of 19 wildlife lands and habitat areas. 20 Sec. 4. Section 483A.3, subsection 3, Code 2017, is amended 21 to read as follows: 22 3. Notwithstanding subsections 1 and 2 , any increase in 23 wildlife habitat fee revenues received on or after July 1, 24 2007, pursuant to this section as a result of wildlife habitat 25 fee increases pursuant to 2007 Iowa Acts, ch. 194 , five dollars 26 from each wildlife habitat fee paid by a resident and eight 27 dollars from each wildlife habitat fee paid by a nonresident 28 shall be used by the commission only for the purpose of the 29 game bird habitat development program programs as provided 30 in section 483A.3B . The commission shall not reduce on an 31 annual basis for these purposes the amount of other funds being 32 expended as of July 1, 2007. 33 Sec. 5. Section 483A.3B, subsection 1, Code 2017, is amended 34 to read as follows: 35 -6- LSB 1477YC (3) 87 av/nh 6/ 12
H.F. _____ 1. Allocation of revenue —— accounts. All revenue collected 1 from increases in wildlife habitat fees as provided in section 2 483A.3, subsection 3 , that is deposited in the state fish and 3 game protection fund shall be allocated as follows: 4 a. Two Three dollars of each resident wildlife habitat 5 fee and five dollars of each nonresident wildlife habitat 6 fee collected shall be allocated to the game bird wetlands 7 conservation account. 8 b. One dollar Two dollars of each resident wildlife habitat 9 fee and three dollars of each nonresident wildlife habitat fee 10 collected shall be allocated to the game bird buffer strip 11 assistance account. 12 c. Notwithstanding section 12C.7, subsection 2 , interest or 13 earnings on moneys collected from wildlife habitat fees that 14 are deposited in each account created under this section shall 15 be credited to that account. Notwithstanding section 8.33 or 16 section 456A.17 , moneys credited to each account created under 17 this section shall not revert to the state general fund at the 18 close of a fiscal year. 19 d. All revenue generated by increases in the collected 20 from wildlife habitat fee fees as provided in section 483A.3, 21 subsection 3 , shall be used as provided in this section , except 22 for that part which is specified by the department for use in 23 paying administrative expenses as provided in section 456A.17 . 24 Sec. 6. NEW SECTION . 483A.6B Nonresident five-day hunting 25 license —— fee. 26 1. A nonresident may be issued a five-day hunting license 27 that costs ninety-five dollars, including the wildlife habitat 28 fee. A nonresident hunting with a license issued under this 29 section shall be otherwise qualified to hunt in this state. 30 2. This section is repealed on December 15, 2020. 31 Sec. 7. Section 483A.7, subsection 3, paragraph a, Code 32 2017, is amended to read as follows: 33 a. A nonresident wild turkey hunter is required to purchase 34 a nonresident annual hunting license that includes the wildlife 35 -7- LSB 1477YC (3) 87 av/nh 7/ 12
H.F. _____ habitat fee and a nonresident wild turkey hunting license. The 1 commission shall annually limit to two thousand three hundred 2 licenses the number of nonresidents allowed to have wild turkey 3 hunting licenses. Of the two thousand three hundred licenses, 4 one hundred fifty licenses shall be valid for hunting with 5 muzzle loading shotguns only. The commission shall allocate 6 the nonresident wild turkey hunting licenses issued among the 7 zones based on the populations of wild turkey. A nonresident 8 applying for a wild turkey hunting license must exhibit proof 9 of having successfully completed a hunter education program as 10 provided in section 483A.27 or its equivalent as determined by 11 the department before the license is issued. 12 Sec. 8. Section 483A.8, subsection 3, paragraph a, Code 13 2017, is amended to read as follows: 14 a. A nonresident hunting deer is required to purchase 15 a nonresident annual hunting license that includes the 16 wildlife habitat fee and a nonresident deer hunting license. 17 In addition, a nonresident who purchases a deer hunting 18 license shall pay a one dollar fee that shall be used and 19 is appropriated for the purpose of deer herd population 20 management, including assisting with the cost of processing 21 deer donated to the help us stop hunger program administered 22 by the commission. 23 Sec. 9. Section 483A.8, subsection 4, Code 2017, is amended 24 to read as follows: 25 4. The commission may provide, by rule, for the issuance 26 of an additional antlerless deer hunting license to a person 27 who has been issued an antlerless deer hunting license. The 28 rules shall specify the number of additional antlerless deer 29 hunting licenses which may be issued, and the season and zone 30 in which the license is valid. The fee for an additional 31 antlerless deer hunting license shall be ten seventeen dollars 32 for residents. 33 Sec. 10. Section 483A.8, subsection 6, Code 2017, is amended 34 to read as follows: 35 -8- LSB 1477YC (3) 87 av/nh 8/ 12

The commission shall provide by rule for the annual 1 issuance to a nonresident of a nonresident antlerless deer 2 hunting license that is valid for use only during the period 3 beginning on December 24 and ending at sunset on January 2 of 4 the following year and costs seventy-five one hundred dollars. 5 A nonresident hunting deer with a license issued under this 6 subsection shall be otherwise qualified to hunt deer in this 7 state and shall purchase a nonresident annual hunting license 8 that includes the wildlife habitat fee, and pay the one dollar 9 fee for the purpose of deer herd population management as 10 provided in subsection 3 . Pursuant to this subsection , the 11 commission shall make available for issuance only the remaining 12 nonresident antlerless deer hunting licenses allocated under 13 subsection 3 that have not yet been issued for the current 14 year’s nonresident antlerless deer hunting seasons. 15 Sec. 11. Section 483A.24, subsection 3, paragraph a, Code 16 2017, is amended to read as follows: 17 a. Fifty of the nonresident deer hunting licenses shall be 18 allocated as requested by a majority of a committee consisting 19 of the majority leader of the senate, speaker of the house 20 of representatives, and director of the economic development 21 authority, or their designees. The licenses provided pursuant 22 to this subsection shall be in addition to the number of 23 nonresident licenses authorized pursuant to section 483A.8 . 24 The purpose of the special nonresident licenses is to allow 25 state officials and local development groups to promote the 26 state and its natural resources to nonresident guests and 27 dignitaries. Photographs, videotapes, or any other form 28 of media resulting from the hunting visitation shall not 29 be used for political campaign purposes. The nonresident 30 licenses shall be issued without application upon purchase of a 31 nonresident annual hunting license that includes the wildlife 32 habitat fee and the purchase of a nonresident deer hunting 33 license. The licenses are valid in all zones open to deer 34 hunting. The hunter education certificate requirement pursuant 35 -9- LSB 1477YC (3) 87 av/nh 9/ 12
H.F. _____ to section 483A.27 is waived for a nonresident issued a license 1 pursuant to this subsection . 2 Sec. 12. Section 483A.24, subsection 4, paragraph a, Code 3 2017, is amended to read as follows: 4 a. Fifty of the nonresident wild turkey hunting licenses 5 shall be allocated as requested by a majority of a committee 6 consisting of the majority leader of the senate, speaker of 7 the house of representatives, and director of the economic 8 development authority, or their designees. The licenses 9 provided pursuant to this subsection shall be in addition 10 to the number of nonresident licenses authorized pursuant 11 to section 483A.7 . The purpose of the special nonresident 12 licenses is to allow state officials and local development 13 groups to promote the state and its natural resources to 14 nonresident guests and dignitaries. Photographs, videotapes, 15 or any other form of media resulting from the hunting 16 visitation shall not be used for political campaign purposes. 17 The nonresident licenses shall be issued without application 18 upon purchase of a nonresident annual hunting license that 19 includes the wildlife habitat fee and the purchase of a 20 nonresident wild turkey hunting license. The licenses are 21 valid in all zones open to wild turkey hunting. The hunter 22 education certificate requirement pursuant to section 483A.27 23 is waived for a nonresident issued a license pursuant to this 24 subsection . 25 Sec. 13. EFFECTIVE DATE. This Act takes effect December 15, 26 2017. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill increases certain fees and reallocates certain 31 revenues related to hunting, fishing, and fur harvesting. 32 The bill increases most fees for resident and nonresident 33 fishing, hunting, and fur harvester licenses. The bill 34 requires the department of natural resources to evaluate the 35 -10- LSB 1477YC (3) 87 av/nh 10/ 12
H.F. _____ license fees at least every three years and report the results 1 of that evaluation to the natural resource commission by 2 December 15 of each year that an evaluation is made. The bill 3 also includes a new five-day nonresident adult hunting license, 4 including the wildlife habitat fee, that costs $95 and is 5 available for issuance for three years. The bill provides that 6 a nonresident who purchases a hunting license in conjunction 7 with a deer or turkey hunting license must purchase an annual 8 hunting license. 9 The bill also increases the wildlife habitat fee for 10 residents and nonresidents from $11 to $15 for residents and 11 $20 for nonresidents. The bill amends Code section 483A.3(1) 12 to provide that the income generated from land acquired with 13 revenues from wildlife habitat fees and matched federal funds 14 shall be used to pay property taxes on that land, and if no 15 income is generated, wildlife habitat fee revenue shall be used 16 to pay the taxes. Currently, the taxes are paid only with 17 wildlife habitat fee revenues. 18 The bill amends Code section 483A.3(3) to provide that 19 $5 from each resident wildlife habitat fee paid and $8 from 20 each nonresident wildlife habitat fee paid shall be used by 21 the natural resource commission only for the purpose of game 22 bird habitat development programs. Currently, the increase 23 in wildlife habitat fee revenues received as a result of an 24 increase in the resident and nonresident wildlife habitat fees 25 in 2007 from $8 to $11, can be used by the commission for the 26 purpose of those programs. 27 The bill amends Code section 483A.3B to provide that all 28 revenue collected from wildlife habitat fees, not just the 29 increase in fees since 2007, shall be allocated to game bird 30 habitat development programs. 31 The bill provides that $3 of each resident wildlife habitat 32 fee and $5 of each nonresident fee collected shall be allocated 33 to the game bird wetlands conservation account. Currently, $2 34 of each resident and nonresident fee collected is allocated to 35 -11- LSB 1477YC (3) 87 av/nh 11/ 12
