H.F. _____ Section 1. Section 29C.2, subsection 6, Code 2017, is 1 amended to read as follows: 2 6. “Local emergency management agency” means a countywide 3 joint county-municipal public safety agency organized to 4 administer this chapter under the authority of a commission. 5 Sec. 2. Section 34A.2, Code 2017, is amended by adding the 6 following new subsection: 7 NEW SUBSECTION . 9A. “Local emergency management agency” 8 means the same as defined in section 29C.2. 9 Sec. 3. Section 34A.2, subsection 15, Code 2017, is amended 10 to read as follows: 11 15. “Public or private safety agency” means a unit of state 12 or local government, a local emergency management agency, a 13 special purpose district, or a private firm which provides or 14 has the authority to provide fire fighting, police, ambulance, 15 emergency medical services, or hazardous materials response. 16 Sec. 4. Section 34A.3, subsection 1, paragraph a, 17 subparagraph (1), Code 2017, is amended to read as follows: 18 (1) (a) Each political subdivision of the state having 19 a public safety agency serving territory within the county 20 is entitled to voting membership on the joint E911 service 21 board. For the purposes of this section subparagraph division , 22 a township that operates a volunteer fire department providing 23 fire protection services to the township, or a city which 24 provides fire protection services through the operation of a 25 volunteer fire department not financed through city government, 26 shall be considered a political subdivision of the state having 27 a public safety agency serving territory within the county. 28 (b) Each local emergency management agency operating within 29 the area is entitled to voting membership on the joint E911 30 service board. 31 (c) Each private safety agency operating within the area is 32 entitled to nonvoting membership on the board. 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -1- LSB 2619YC (1) 87 gh/rn 1/ 2
H.F. _____ the explanation’s substance by the members of the general assembly. 1 This bill relates to local emergency management agencies. 2 The bill modifies the definition of “local emergency 3 management agency” in Code section 29C.2(6) by specifying that 4 such an agency is a public safety agency. The bill adds the 5 same definition of “local emergency management agency” to Code 6 section 34A.2, relating to enhanced 911 emergency telephone 7 systems. The bill modifies the definition of “public or 8 private safety agency” in Code section 34A.2(15) to include 9 local emergency management agencies. 10 The bill provides local emergency management agencies with 11 voting membership on joint E911 service boards, in addition to 12 political subdivisions served by public safety agencies, as 13 currently provided in Code section 34A.3(1)(a)(1). 14 -2- LSB 2619YC (1) 87 gh/rn 2/ 2
