H.F. _____ Section 1. Section 331.391, subsection 4, Code 2017, is 1 amended to read as follows: 2 4. If a region is meeting the financial obligations for 3 implementation of its regional service system management 4 plan for a fiscal year and residual funding is anticipated, 5 the regional administrator shall reserve an adequate amount 6 for cash flow of expenditure obligations in the next fiscal 7 year. The cash flow amount shall not exceed twenty-five 8 percent of the gross expenditures budgeted for the combined 9 account or for all regional accounts for the fiscal year in 10 progress. Residual funding remaining after the cash flow 11 amount is reserved shall be used to expand the region’s core 12 services under section 331.397, subsection 4 , and then to make 13 additional core service domains available in the region as 14 enumerated in section 331.397, subsection 6 . 15 Sec. 2. Section 331.397, subsection 4, Code 2017, is amended 16 by adding the following new paragraphs: 17 NEW PARAGRAPH . g. Comprehensive facility and 18 community-based crisis services, including but not limited to 19 all of the following: 20 (1) Twenty-four-hour crisis hotline. 21 (2) Mobile response. 22 (3) Twenty-three-hour crisis observation and holding, and 23 crisis stabilization facility and community-based services. 24 (4) Crisis residential services. 25 NEW PARAGRAPH . h. Subacute services provided in facility 26 and community-based settings. 27 NEW PARAGRAPH . i. Justice system-involved services, 28 including but not limited to all of the following: 29 (1) Jail diversion. 30 (2) Crisis intervention training. 31 (3) Civil commitment prescreening. 32 NEW PARAGRAPH . j. H.F. _____ (2) Assertive community treatment. 1 (3) Peer self-help drop-in centers. 2 Sec. 3. Section 331.397, subsection 6, Code 2017, is amended 3 by striking the subsection. 4 Sec. 4. DIRECTIVE TO DEPARTMENT OF HUMAN SERVICES —— 5 PSYCHIATRIC BED TRACKING SYSTEM. The department of human 6 services shall amend its administrative rules pursuant to 7 chapter 17A to require the state mental health institutes 8 and hospitals licensed to provide inpatient psychiatric 9 treatment and services to participate in the psychiatric bed 10 tracking system and to report the number of beds available 11 for persons with a co-occurring mental illness and substance 12 abuse disorder. The department shall issue a quarterly report 13 on state mental health institutes and hospitals licensed to 14 provide inpatient psychiatric treatment and services that are 15 noncompliant with daily updates. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill relates to access to certain mental health, 20 substance abuse, and disability services. 21 Under current law, a mental health and disability services 22 region must make certain initial core services available to 23 eligible residents of a region including residents with a 24 diagnosis of a mental illness, subject to available funding 25 and regardless of the funding source for the service. If 26 money is available after funding the initial core services, a 27 region must make certain additional core services available to 28 eligible residents who are not eligible for Medicaid or who 29 are not receiving other third-party payments for the services, 30 when public funds are made available for such services. The 31 additional core services include comprehensive facility and 32 community-based crisis services, subacute services provided in 33 facility and community-based settings, justice system-involved 34 service, and evidence-based treatment. H.F. _____ law to redesignate these additional core services as initial 1 core services that must be made available by a region. 2 The bill directs the department of human services to 3 amend its administrative rules to require the state mental 4 health institutes and hospitals licensed to provide inpatient 5 psychiatric treatment and services to participate in the 6 psychiatric bed tracking system and to report the number of 7 beds available for persons with a co-occurring mental illness 8 and substance abuse disorder.
