H.F. 67 Section 1. Section 455B.381, Code 2017, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 01. “Carcinogen” means any substance listed 3 as a group 1 or group 2A agent by the world health organization 4 international agency for research on cancer. 5 Sec. 2. NEW SECTION . 455B.387A Carcinogen inventory and 6 replacement. 7 1. a. The department shall annually inventory carcinogens 8 used by the state or any political subdivision of the state for 9 any purpose. 10 b. The department shall produce and maintain a list of 11 alternatives to the use of carcinogens. 12 2. The department shall monitor and submit a report to the 13 general assembly by January 1 of each year regarding the plans 14 of the state or its political subdivisions to discontinue the 15 use of carcinogens included in the inventory conducted under 16 subsection 1. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill directs the department of natural resources 21 (department) to inventory the state and its political 22 subdivisions to determine whether any carcinogens are being 23 used. The bill provides a definition of the term “carcinogen”. 24 The bill requires the department to produce and maintain a list 25 of alternatives to the use of carcinogens. The bill requires 26 the department to monitor and submit a report to the general 27 assembly by January 1 of each year regarding the plans of the 28 state or its political subdivisions to discontinue the use 29 of carcinogens included in the inventory conducted by the 30 department. 31 -1- LSB 1334YH (2) 87 tr/sc 1/ 1
