H.F. 649 Section 1. Section 135.166, subsection 2, as enacted in 2017 1 Iowa Acts, House File 393, section 104, if enacted, is amended 2 to read as follows: 3 2. Unless otherwise authorized or required by state or 4 federal law, data collected under this section shall not 5 include the social security number or name of the individual 6 subject of the data. 7 Sec. 2. Section 144.43, subsection 3, unnumbered paragraph 8 1, Code 2017, is amended to read as follows: 9 However, the following vital statistics records may be 10 inspected and copied as of right under chapter 22 , if requested 11 by a member of the news media or an entitled person as defined 12 by rule, when they the records are in the custody of a county 13 registrar or when they the records are in the custody of the 14 state archivist and are at least seventy-five years old: 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill relates to records and data including activities 19 relating to vital statistics records and the collection and 20 use of health data by the department of public health. The 21 bill amends Code section 135.166, if enacted in 2017 Iowa Acts, 22 House File 393, to provide that in addition to prohibiting the 23 collection of the social security number of the individual 24 subject of the data, collection of the name of such individual 25 is also prohibited. 26 The bill also provides that when a record of birth; a record 27 of marriage; a record of divorce, dissolution of marriage, or 28 annulment of marriage; or a record of death if that death was 29 not a fetal death is in the custody of the county registrar 30 or in the custody of the state archivist and the record is at 31 least 75 years old, if requested by a member of the news media 32 or an entitled person as defined by rule, the record may be 33 inspected and copied as of right under Code chapter 22. 34 -1- LSB 2671HV (2) 87 pf/rj 1/ 1
