H.F. 643 DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the fiscal year beginning July 1, 2017, and ending June 6 30, 2018, the following amounts, or so much thereof as is 7 necessary, to be used for the purposes designated: 8 1. DEPARTMENT OF ADMINISTRATIVE SERVICES 9 For major maintenance projects: 10 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,010,000 11 Of the moneys appropriated in this subsection, the 12 department shall expend such amount as is necessary for the 13 repair of elevators in facilities on the state capitol complex. 14 2. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 15 a. (1) For deposit in the water quality initiative fund 16 created in section 466B.45 for purposes of supporting the 17 water quality initiative administered by the division of soil 18 conservation and water quality as provided in section 466B.42, 19 including salaries, support, maintenance, and miscellaneous 20 purposes, notwithstanding section 8.57, subsection 5, paragraph 21 “c”: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,200,000 23 (2) (a) The moneys appropriated in this lettered 24 paragraph shall be used to support demonstration projects in 25 subwatersheds as designated by the department that are part 26 of high-priority watersheds identified by the water resources 27 coordinating council. 28 (b) The moneys appropriated in this lettered paragraph 29 shall be used to support demonstration projects in watersheds 30 generally, including regional watersheds, as designated by the 31 division and high-priority watersheds identified by the water 32 resources coordinating council. 33 (c) Of the moneys appropriated in this lettered paragraph 34 for each fiscal year, $225,000 is allocated to the Iowa 35 -1- LSB 1054HV (1) 87 ec/tm 1/ 16
H.F. 643 nutrient research center at Iowa state university of science 1 and technology for nutrient water monitoring network technology 2 and equipment. Of the moneys allocated in this subparagraph 3 division, not more than $150,000 may be used for the operations 4 and maintenance of the nutrient water monitoring network. 5 (3) In supporting projects in watersheds and subwatersheds 6 as provided in subparagraph (2), subparagraph divisions (a) and 7 (b), all of the following shall apply: 8 (a) The demonstration projects shall utilize water quality 9 practices as described in the latest revision of the document 10 entitled “Iowa Nutrient Reduction Strategy” initially presented 11 in November 2012 by the department of agriculture and land 12 stewardship, the department of natural resources, and Iowa 13 state university of science and technology. 14 (b) The division shall implement demonstration projects 15 as provided in subparagraph division (a) by providing 16 for participation by persons who hold a legal interest in 17 agricultural land used in farming. To every extent practical, 18 the division shall provide for collaborative participation by 19 such persons who hold a legal interest in agricultural land 20 located within the same subwatershed. 21 (c) The division shall implement demonstration projects on 22 a cost-share basis as determined by the division. However, the 23 state’s share of the amount shall not exceed 50 percent of the 24 estimated cost of establishing the practice as determined by 25 the division or 50 percent of the actual cost of establishing 26 the practice, whichever is less. 27 (d) The demonstration projects shall be used to educate 28 other persons about the feasibility and value of establishing 29 similar water quality practices. The division shall promote 30 field day events for purposes of allowing interested persons to 31 establish water quality practices on their agricultural land. 32 (e) The division shall conduct water quality evaluations 33 within supported subwatersheds. Within a reasonable period 34 after accumulating information from such evaluations, the 35 -2- LSB 1054HV (1) 87 ec/tm 2/ 16
H.F. 643 division shall create an aggregated database of water quality 1 practices. Any information identifying a person holding a 2 legal interest in agricultural land or specific agricultural 3 land shall be a confidential record. 4 (4) The moneys appropriated in this lettered paragraph 5 shall be used to support education and outreach in a manner 6 that encourages persons who hold a legal interest in 7 agricultural land used for farming to implement water quality 8 practices, including the establishment of such practices in 9 watersheds generally, and not limited to subwatersheds or 10 high-priority watersheds. 11 (5) The moneys appropriated in this lettered paragraph 12 may be used to contract with persons to coordinate the 13 implementation of efforts provided in this paragraph. 14 (6) The moneys appropriated in this lettered paragraph 15 may be used by the department to support urban soil and water 16 conservation efforts, which may include but are not limited 17 to management practices related to bioretention, landscaping, 18 the use of permeable or pervious pavement, and soil quality 19 restoration. The moneys shall be allocated on a cost-share 20 basis as provided in chapter 161A. 21 (7) Notwithstanding any other provision of law to the 22 contrary, the department may use moneys appropriated in 23 this lettered paragraph to carry out the provisions of this 24 paragraph on a cost-share basis in combination with other 25 moneys available to the department from a state or federal 26 source. 27 (8) Not more than 10 percent of the moneys appropriated in 28 this lettered paragraph may be used for costs of administration 29 and implementation of the water quality initiative administered 30 by the soil conservation division. 31 b. For deposit in the agricultural drainage well water 32 quality assistance fund created in section 460.303 for 33 purposes of supporting the agricultural drainage well water 34 quality assistance program as provided in section 460.304, 35 -3- LSB 1054HV (1) 87 ec/tm 3/ 16

From any moneys appropriated 14 in this subsection and remaining upon completion of the 15 repair and renovation of the dome of the Iowa state capitol, 16 the department shall expend such amount as is necessary for 17 maintenance projects for the Iowa state capitol and the Ola 18 Babcock Miller building. 19 Sec. 14. EFFECTIVE UPON ENACTMENT. The following provision 20 of this division of this Act, being deemed of immediate 21 importance, takes effect upon enactment: 22 1. The section of this division of this Act amending 2016 25 Iowa Acts, chapter 1133, section 6, subsection 1. 26 DIVISION V 27 MISCELLANEOUS PROVISIONS 28 Sec. 15. Section 8.57, subsection 5, paragraph c, Code 2017, 29 is amended to read as follows: 30 c. Moneys in the rebuild Iowa infrastructure fund in a 31 fiscal year shall be used as directed by the general assembly 32 for public vertical infrastructure projects. For the purposes 33 of this subsection , “vertical infrastructure” includes only land 34 acquisition and construction; major renovation and major repair 35 -13- LSB 1054HV (1) 87 ec/tm 13/ 16
H.F. 643 of buildings; routine, recurring maintenance; all appurtenant 1 structures; utilities; site development; recreational trails; 2 renewable fuel infrastructure programs; and debt service 3 payments on academic revenue bonds issued in accordance 4 with chapter 262A for capital projects at board of regents 5 institutions. “Vertical infrastructure” does not include 6 operational expenses or leasing of a building, appurtenant 7 structure, or utility without a lease-purchase agreement. 8 Sec. 16. Section 8.57C, subsection 3, paragraph a, 9 subparagraph (2), Code 2017, is amended to read as follows: 10 (2) The fiscal year beginning July 1, 2017 2018 , and for 11 each subsequent fiscal year thereafter. 12 Sec. 17. Section 8.57C, subsection 3, Code 2017, is amended 13 by adding the following new paragraph: 14 NEW PARAGRAPH . f. There is appropriated from the rebuild 15 Iowa infrastructure fund for the fiscal year beginning July 1, 16 2017, and ending June 30, 2018, the sum of ten million dollars 17 to the technology reinvestment fund, notwithstanding section 18 8.57, subsection 5, paragraph “c” . 19 Sec. 18. Section 12.88, Code 2017, is amended by adding the 20 following new subsection: 21 NEW SUBSECTION . 6. For the fiscal year beginning July 1, 22 2017, any unobligated and unencumbered moneys in the fund from 23 the previous fiscal year are appropriated to the department of 24 administrative services for major maintenance projects. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 This bill relates to and makes appropriations to state 29 departments and agencies from the rebuild Iowa infrastructure 30 fund and the revenue bonds capitals fund, and provides for 31 related matters. The bill is organized by divisions. 32 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 33 division appropriates project funding for FY 2017-2018 from 34 the rebuild Iowa infrastructure fund for projects for the 35 -14- LSB 1054HV (1) 87 ec/tm 14/ 16
H.F. 643 departments of administrative services, agriculture and land 1 stewardship, the blind, cultural affairs, human rights, human 2 services, natural resources, public defense, public safety, and 3 transportation, and for the economic development authority, 4 treasurer of state, and the board of regents. 5 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This division 6 appropriates project funding for FY 2017-2018 from the 7 technology reinvestment fund for the departments of education, 8 human rights, human services, management, public health, public 9 safety, and homeland security and emergency management, and 10 for the office of the chief information officer and the state 11 public defender. 12 DIVISION III —— MISCELLANEOUS APPROPRIATIONS. This division 13 appropriates project funding for FY 2016-2017 from the revenue 14 bonds capitals fund to the department of administrative 15 services for major maintenance projects and for FY 2017-2018 16 from the state bond repayment fund for the state board of 17 regents for tuition replacement. This division takes effect 18 upon enactment. 19 DIVISION IV —— CHANGES TO PRIOR APPROPRIATIONS. This 20 division makes a change to moneys appropriated from the 21 rebuild Iowa infrastructure fund to the board of regents for 22 a project at the state university of Iowa and projects at 23 the Iowa state university of science and technology for FY 24 2017-2018 and FY 2021-2022. The division also makes a change 25 to moneys appropriated from the state bond repayment fund to 26 the department of administrative services for repair of the 27 dome of the Iowa state capitol for FY 2016-2017 to authorize 28 expenditure of moneys remaining upon completion of repairs to 29 the dome for maintenance projects for the Iowa state capitol 30 and the Ola Babcock Miller building. This provision takes 31 effect upon enactment. 32 This division also makes a change to moneys appropriated 33 from the rebuild Iowa infrastructure fund to the department of 34 administrative services for major maintenance projects for FY 35 -15- LSB 1054HV (1) 87 ec/tm 15/ 16

This provision takes effect upon enactment. 1 This division also makes a change in moneys appropriated 2 from the rebuild Iowa infrastructure fund to the state fair 3 authority for FY 2017-2018. 4 DIVISION V —— MISCELLANEOUS PROVISIONS. Code section 8.57, 5 concerning the rebuild Iowa infrastructure fund, is amended 6 to provide that the definition of “vertical infrastructure” 7 specifically includes renewable fuel infrastructure programs. 8 Code section 8.57C, concerning the technology reinvestment 9 fund, is amended to provide that the appropriation to the 10 fund from the general fund for fiscal years beginning on or 11 after July 1, 2017, is changed to fiscal years beginning on 12 or after July 1, 2018, and to provide for an appropriation to 13 the fund from the rebuild Iowa infrastructure fund for the 14 fiscal year beginning July 1, 2017, of $10 million.
