H.F. 602 Section 1. Section 282.34, Code 2017, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4A. Subsection 1, paragraph “a” , relating 3 to the provision of an educational program and appropriate 4 education services, shall not apply to a children’s residential 5 facility if the facility is utilizing the accelerated Christian 6 education curriculum program as its primary curriculum on the 7 effective date of this Act and the facility was in operation 8 prior to the effective date of this Act. 9 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 10 immediate importance, takes effect upon enactment. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill exempts a children’s residential facility from 15 a requirement that such a facility provide an educational 16 program and appropriate education services to children residing 17 therein by contracting with the school district in which the 18 children’s residential facility is located, contracting with 19 an accredited nonpublic school, or becoming accredited as a 20 nonpublic school. To be exempt, the facility must be utilizing 21 the accelerated Christian education curriculum program as its 22 primary curriculum on the bill’s effective date and must have 23 been in operation prior to the bill’s effective date. 24 The bill takes effect upon enactment. 25 -1- LSB 1316HV (2) 87 kh/rj 1/ 1
