NEW SECTION . 483A.1B License fees —— periodic 23 evaluation. 24 1. The license fees established in section 483A.1 shall be 25 periodically evaluated by the department, but not less often 26 than once every three years to ensure that the fees paid are 27 sufficient to meet the needs of natural resource management and 28 the public. 29 2. By December 15 of each year that an evaluation of the 30 license fees is completed, the department shall file a written 31 report with the commission which shall include the findings of 32 the evaluation and recommendations, if any. 33 Sec. 3. Section 483A.3, subsection 1, paragraphs c and d, 34 Code 2017, are amended to read as follows: 35 -5- LSB 1477HV (4) 87 av/nh 5/ 12

Eleven Fifteen dollars of the fee paid for each resident 1 or nonresident hunting or fur harvester license that includes 2 the wildlife habitat fee and twenty dollars of the fee paid for 3 each nonresident hunting or fur harvester license that includes 4 the wildlife habitat fee shall be designated as a wildlife 5 habitat fee. 6 d. All wildlife habitat fees shall be administered in 7 the same manner as hunting and fur harvester licenses except 8 all revenue derived from wildlife habitat fees shall be used 9 within the state of Iowa for habitat development and shall be 10 deposited in the state fish and game protection fund, except 11 as provided in subsection 2 . The revenue may be used for 12 the matching of federal funds. The revenues and any matched 13 federal funds shall be used for acquisition of land, leasing of 14 land, or obtaining of easements from willing sellers for use 15 as wildlife habitats. Notwithstanding the exemption provided 16 by section 427.1 , any land acquired with the revenues and 17 matched federal funds shall be subject to the full consolidated 18 levy of property taxes , which shall be paid from those the 19 income generated from those lands or, if no such income is 20 generated, from the wildlife habitat fee revenues. In addition 21 the revenue may be used for the development and enhancement of 22 wildlife lands and habitat areas. 23 Sec. 4. Section 483A.3, subsection 3, Code 2017, is amended 24 to read as follows: 25 3. Notwithstanding subsections 1 and 2 , any increase in 26 wildlife habitat fee revenues received on or after July 1, 27 2007, pursuant to this section as a result of wildlife habitat 28 fee increases pursuant to 2007 Iowa Acts, ch. 194 , five dollars 29 from each wildlife habitat fee paid by a resident and eight 30 dollars from each wildlife habitat fee paid by a nonresident 31 shall be used by the commission only for the purpose of the 32 game bird habitat development program programs as provided 33 in section 483A.3B . The commission shall not reduce on an 34 annual basis for these purposes the amount of other funds being 35 -6- LSB 1477HV (4) 87 av/nh 6/ 12
H.F. 574 expended as of July 1, 2007. 1 Sec. 5. Section 483A.3B, subsection 1, Code 2017, is amended 2 to read as follows: 3 1. Allocation of revenue —— accounts. All revenue collected 4 from increases in wildlife habitat fees as provided in section 5 483A.3, subsection 3 , that is deposited in the state fish and 6 game protection fund shall be allocated as follows: 7 a. Two Three dollars of each resident wildlife habitat 8 fee and five dollars of each nonresident wildlife habitat 9 fee collected shall be allocated to the game bird wetlands 10 conservation account. 11 b. One dollar Two dollars of each resident wildlife habitat 12 fee and three dollars of each nonresident wildlife habitat fee 13 collected shall be allocated to the game bird buffer strip 14 assistance account. 15 c. Notwithstanding section 12C.7, subsection 2 , interest or 16 earnings on moneys collected from wildlife habitat fees that 17 are deposited in each account created under this section shall 18 be credited to that account. Notwithstanding section 8.33 or 19 section 456A.17 , moneys credited to each account created under 20 this section shall not revert to the state general fund at the 21 close of a fiscal year. 22 d. All revenue generated by increases in the collected 23 from wildlife habitat fee fees as provided in section 483A.3, 24 subsection 3 , shall be used as provided in this section , except 25 for that part which is specified by the department for use in 26 paying administrative expenses as provided in section 456A.17 . 27 Sec. 6. NEW SECTION . 483A.6B Nonresident five-day hunting 28 license —— fee. 29 1. A nonresident may be issued a five-day hunting license 30 that costs ninety-five dollars, including the wildlife habitat 31 fee. A nonresident hunting with a license issued under this 32 section shall be otherwise qualified to hunt in this state. 33 2. This section is repealed on December 15, 2020. 34 Sec. 7. Section 483A.7, subsection 3, paragraph a, Code 35 -7- LSB 1477HV (4) 87 av/nh 7/ 12
H.F. 574 2017, is amended to read as follows: 1 a. A nonresident wild turkey hunter is required to purchase 2 a nonresident annual hunting license that includes the wildlife 3 habitat fee and a nonresident wild turkey hunting license. The 4 commission shall annually limit to two thousand three hundred 5 licenses the number of nonresidents allowed to have wild turkey 6 hunting licenses. Of the two thousand three hundred licenses, 7 one hundred fifty licenses shall be valid for hunting with 8 muzzle loading shotguns only. The commission shall allocate 9 the nonresident wild turkey hunting licenses issued among the 10 zones based on the populations of wild turkey. A nonresident 11 applying for a wild turkey hunting license must exhibit proof 12 of having successfully completed a hunter education program as 13 provided in section 483A.27 or its equivalent as determined by 14 the department before the license is issued. 15 Sec. 8. Section 483A.8, subsection 3, paragraph a, Code 16 2017, is amended to read as follows: 17 a. A nonresident hunting deer is required to purchase 18 a nonresident annual hunting license that includes the 19 wildlife habitat fee and a nonresident deer hunting license. 20 In addition, a nonresident who purchases a deer hunting 21 license shall pay a one dollar fee that shall be used and 22 is appropriated for the purpose of deer herd population 23 management, including assisting with the cost of processing 24 deer donated to the help us stop hunger program administered 25 by the commission. 26 Sec. 9. Section 483A.8, subsection 4, Code 2017, is amended 27 to read as follows: 28 4. The commission may provide, by rule, for the issuance 29 of an additional antlerless deer hunting license to a person 30 who has been issued an antlerless deer hunting license. The 31 rules shall specify the number of additional antlerless deer 32 hunting licenses which may be issued, and the season and zone 33 in which the license is valid. The fee for an additional 34 antlerless deer hunting license shall be ten seventeen dollars 35 -8- LSB 1477HV (4) 87 av/nh 8/ 12
H.F. 574 for residents. 1 Sec. 10. Section 483A.8, subsection 6, Code 2017, is amended 2 to read as follows: 3 6. The commission shall provide by rule for the annual 4 issuance to a nonresident of a nonresident antlerless deer 5 hunting license that is valid for use only during the period 6 beginning on December 24 and ending at sunset on January 2 of 7 the following year and costs seventy-five one hundred dollars. 8 A nonresident hunting deer with a license issued under this 9 subsection shall be otherwise qualified to hunt deer in this 10 state and shall purchase a nonresident annual hunting license 11 that includes the wildlife habitat fee, and pay the one dollar 12 fee for the purpose of deer herd population management as 13 provided in subsection 3 . Pursuant to this subsection , the 14 commission shall make available for issuance only the remaining 15 nonresident antlerless deer hunting licenses allocated under 16 subsection 3 that have not yet been issued for the current 17 year’s nonresident antlerless deer hunting seasons. 18 Sec. 11. Section 483A.24, subsection 3, paragraph a, Code 19 2017, is amended to read as follows: 20 a. Fifty of the nonresident deer hunting licenses shall be 21 allocated as requested by a majority of a committee consisting 22 of the majority leader of the senate, speaker of the house 23 of representatives, and director of the economic development 24 authority, or their designees. The licenses provided pursuant 25 to this subsection shall be in addition to the number of 26 nonresident licenses authorized pursuant to section 483A.8 . 27 The purpose of the special nonresident licenses is to allow 28 state officials and local development groups to promote the 29 state and its natural resources to nonresident guests and 30 dignitaries. Photographs, videotapes, or any other form 31 of media resulting from the hunting visitation shall not 32 be used for political campaign purposes. The nonresident 33 licenses shall be issued without application upon purchase of a 34 nonresident annual hunting license that includes the wildlife 35 -9- LSB 1477HV (4) 87 av/nh 9/ 12
H.F. 574 habitat fee and the purchase of a nonresident deer hunting 1 license. The licenses are valid in all zones open to deer 2 hunting. The hunter education certificate requirement pursuant 3 to section 483A.27 is waived for a nonresident issued a license 4 pursuant to this subsection . 5 Sec. 12. Section 483A.24, subsection 4, paragraph a, Code 6 2017, is amended to read as follows: 7 a. Fifty of the nonresident wild turkey hunting licenses 8 shall be allocated as requested by a majority of a committee 9 consisting of the majority leader of the senate, speaker of 10 the house of representatives, and director of the economic 11 development authority, or their designees. The licenses 12 provided pursuant to this subsection shall be in addition 13 to the number of nonresident licenses authorized pursuant 14 to section 483A.7 . This Act takes effect December 15, 29 2017. 30 EXPLANATION 31 The inclusion of this explanation does not constitute agreement with 32 the explanation’s substance by the members of the general assembly. 33 This bill increases certain fees and reallocates certain 34 revenues related to hunting, fishing, and fur harvesting. 35 -10- LSB 1477HV (4) 87 av/nh 10/ 12
H.F. 574 The bill increases most fees for resident and nonresident 1 fishing, hunting, and fur harvester licenses. The bill 2 requires the department of natural resources to evaluate the 3 license fees at least every three years and report the results 4 of that evaluation to the natural resource commission by 5 December 15 of each year that an evaluation is made. The bill 6 provides that a resident deer hunting license for antlered or 7 any sex deer costs $35 and a resident antlerless deer only 8 deer hunting license is available for $25.50. The bill also 9 includes a new five-day nonresident adult hunting license, 10 including the wildlife habitat fee, that costs $95 and is 11 available for issuance for three years. The bill provides that 12 a nonresident who purchases a hunting license in conjunction 13 with a deer or turkey hunting license must purchase an annual 14 hunting license. 15 The bill also increases the wildlife habitat fee for 16 residents and nonresidents from $11 to $15 for residents and 17 $20 for nonresidents. The bill amends Code section 483A.3(1) 18 to provide that the income generated from land acquired with 19 revenues from wildlife habitat fees and matched federal funds 20 shall be used to pay property taxes on that land, and if no 21 income is generated, wildlife habitat fee revenue shall be used 22 to pay the taxes. Currently, the taxes are paid only with 23 wildlife habitat fee revenues. 24 The bill amends Code section 483A.3(3) to provide that 25 $5 from each resident wildlife habitat fee paid and $8 from 26 each nonresident wildlife habitat fee paid shall be used by 27 the natural resource commission only for the purpose of game 28 bird habitat development programs. Currently, the increase 29 in wildlife habitat fee revenues received as a result of an 30 increase in the resident and nonresident wildlife habitat fees 31 in 2007 from $8 to $11, can be used by the commission for the 32 purpose of those programs. 33 The bill amends Code section 483A.3B to provide that all 34 revenue collected from wildlife habitat fees, not just the 35 -11- LSB 1477HV (4) 87 av/nh 11/ 12
H.F. 574 increase in fees since 2007, shall be allocated to game bird 1 habitat development programs. 2 The bill provides that $3 of each resident wildlife habitat 3 fee and $5 of each nonresident fee collected shall be allocated 4 to the game bird wetlands conservation account. Currently, $2 5 of each resident and nonresident fee collected is allocated to 6 that account. 7 The bill also provides that $2 of each resident fee and $3 of 8 each nonresident fee collected shall be allocated to the game 9 bird buffer strip assistance account.
