Exercise
of
powers
——

construction.

1.
The
board
of
directors
of
a
school
district
shall
3
operate,
control,
and
supervise
all
public
schools
located
4
within
its
district
boundaries
and
may
exercise
any
broad
and
5
implied
power,
not
inconsistent
with
the
laws
of
the
general
6
assembly
and
administrative
rules
adopted
by
state
agencies
7
pursuant
thereto,
related
to
the
operation,
control,
and
8
supervision
of
those
public
schools.

2.
Notwithstanding
subsection
1,
the
board
of
directors
of
10
a
school
district
shall
not
have
power
to
levy
any
tax
unless
11
expressly
authorized
by
the
general
assembly.

This
chapter,
chapter
257,
chapter
257B,
and
chapters
13
275
through
301,
and
other
statutes
relating
to
the
boards
of
14
directors
of
school
districts
and
to
school
districts
shall
be
15
liberally
construed
to
effectuate
the
purposes
of
subsection
1.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
18
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
exercise
of
powers
by
the
board
of
20
directors
of
a
school
district.
21
The
bill
authorizes
a
school
board
to
exercise
any
broad
22
or
implied
power,
not
inconsistent
with
the
laws
of
the
23
general
assembly
and
administrative
rules
adopted
pursuant
24
thereto,
related
to
the
operation,
control,
and
supervision
25
of
the
public
schools
located
within
its
district
boundaries.

However,
the
authority
does
not
encompass
the
power
to
levy
27
any
tax
unless
expressly
authorized
by
the
general
assembly.
28
Statutes
relating
to
school
boards
and
school
districts
shall
29
be
liberally
construed
to
effectuate
the
authority
granted
30
under
the
bill.
