H.F. 563 DIVISION I 1 SCHOOL COACHES —— EMERGENCY MEDICAL PROCEDURES TRAINING 2 Section 1. Section 272.31, subsection 1, paragraph a, Code 3 2017, is amended by adding the following new subparagraph: 4 NEW SUBPARAGRAPH . (05) Successful completion of a 5 certification course for cardiopulmonary resuscitation and use 6 of an automated external defibrillator. 7 Sec. 2. Section 279.19B, subsection 1, Code 2017, is amended 8 by adding the following new paragraph: 9 NEW PARAGRAPH . 0b. An individual employed under paragraph 10 “a” shall possess a valid certificate of completion of a 11 nationally recognized course in cardiopulmonary resuscitation 12 and use of an automated external defibrillator. 13 Sec. 3. APPLICABILITY PROVISIONS. A person who possesses 14 a valid teaching license with a coaching endorsement or a 15 coaching authorization issued by the board of educational 16 examiners prior to July 1, 2017, shall have until July 1, 2018, 17 to meet the requirements of this division of this Act. 18 DIVISION II 19 CONCUSSIONS OR BRAIN INJURY POLICIES 20 Sec. 4. Section 280.13C, Code 2017, is amended by striking 21 the section and inserting in lieu thereof the following: 22 280.13C Concussion and brain injury policies. 23 1. Legislative findings. The general assembly finds and 24 declares all of the following: 25 a. Concussions are one of the most commonly reported 26 injuries in children and adolescents who participate in sports 27 and recreational activities. A concussion is caused by a blow 28 or motion to the head or body that causes the brain to move 29 rapidly inside the skull. The risk of catastrophic injuries or 30 death is significant when a concussion or head injury is not 31 properly evaluated and managed. 32 b. Concussions are a type of brain injury that can range 33 from mild to severe and can disrupt the way the brain normally 34 works. Concussions can occur in any organized or unorganized 35 -1- LSB 1453HV (2) 87 je/jh/rj 1/ 8
H.F. 563 sport or recreational activity and can result from a fall or 1 from players colliding with each other, the ground, or with 2 obstacles. Concussions can occur with or without loss of 3 consciousness, but the vast majority of concussions occur 4 without loss of consciousness. 5 c. Continuing to play with a concussion or symptoms of a 6 head injury leaves a young athlete especially vulnerable to 7 greater injury and even death. The general assembly recognizes 8 that, despite having generally recognized return-to-play 9 standards for concussions and head injuries, some affected 10 youth athletes are prematurely returned to play, resulting in 11 actual or potential physical injury or death to youth athletes 12 in this state. 13 d. A student athlete who has sustained a concussion may need 14 informal or formal accommodations, modifications of curriculum, 15 and monitoring by medical or educational staff until the 16 student is fully recovered. To that end, the Iowa high school 17 athletic association and the Iowa girls high school athletic 18 union are encouraged to establish and disseminate to all 19 schools in this state a return-to-school protocol that is based 20 on peer-reviewed scientific evidence consistent with federal 21 guidelines and includes baseline testing for student athletes. 22 Furthermore, all schools in this state are encouraged to adopt 23 such protocols. 24 2. Definitions. For the purposes of this section: 25 a. “Contest” means an interscholastic athletic game. 26 b. “Contest official” means a referee, umpire, judge, or 27 other official in an athletic contest. 28 c. “Extracurricular interscholastic activity” means any 29 extracurricular interscholastic activity, contest, or practice, 30 including sports, dance, or cheerleading. 31 d. “Licensed health care provider” means a physician, 32 physician assistant, chiropractor, advanced registered nurse 33 practitioner, nurse, physical therapist, or athletic trainer 34 licensed by a board designated under section 147.13. 35 -2- LSB 1453HV (2) 87 je/jh/rj 2/ 8
H.F. 563 3. Training. 1 a. The Iowa high school athletic association and the Iowa 2 girls high school athletic union shall work together to develop 3 training materials and courses regarding concussions and brain 4 injuries, including training regarding evaluation, prevention, 5 symptoms, risks, and long-term effects of concussions and brain 6 injuries. Each coach or contest official shall complete such 7 training at least every two years. 8 b. Individuals required to complete training pursuant to 9 this subsection shall submit proof of such completion to the 10 board of directors of the school district or the authorities in 11 charge of the accredited nonpublic school within thirty days 12 of such completion. 13 4. Guidelines and information sheet. 14 a. The Iowa high school athletic association and the 15 Iowa girls high school athletic union shall work together to 16 distribute the centers for disease control and prevention 17 guidelines and other pertinent information to inform and 18 educate coaches, students, and the parents and guardians 19 of students of the risks, signs, symptoms, and behaviors 20 consistent with a concussion or brain injury, including 21 the danger of continuing to participate in extracurricular 22 interscholastic activities after suffering a concussion or 23 brain injury and their responsibility to report such signs, 24 symptoms, and behaviors if they occur. 25 b. Annually, each school district and nonpublic school shall 26 provide to the parent or guardian of each student a concussion 27 and brain injury information sheet, as provided by the Iowa 28 high school athletic association and the Iowa girls high 29 school athletic union. The student and the student’s parent 30 or guardian shall sign and return the concussion and brain 31 injury information sheet to the student’s school prior to the 32 student’s participation in any extracurricular interscholastic 33 activity for grades seven through twelve. 34 5. Removal from participation. If a student’s coach, 35 -3- LSB 1453HV (2) 87 je/jh/rj 3/ 8
H.F. 563 contest official, or licensed health care provider observes 1 signs, symptoms, or behaviors consistent with a concussion or 2 brain injury in an extracurricular interscholastic activity, 3 the student shall be immediately removed from participation. 4 6. Return-to-play protocols. The Iowa high school athletic 5 association and the Iowa girls high school athletic union 6 shall work together to develop a return-to-play protocol, 7 based on peer-reviewed scientific evidence consistent with the 8 guidelines of the centers for disease control and prevention 9 of the United States department of health and human services, 10 for a student’s return to participation in an extracurricular 11 interscholastic activity after showing signs, symptoms, or 12 behaviors consistent with a concussion or brain injury. The 13 board of directors of each school district and the authorities 14 in charge of each accredited nonpublic school with enrolled 15 students who participate in an extracurricular interscholastic 16 activity which is a contest in grades seven through twelve 17 shall adopt such protocols. 18 7. Protective gear. For school budget years beginning on 19 or after July 1, 2017, the board of directors of each school 20 district and the authorities in charge of each accredited 21 nonpublic school with enrolled students who participate 22 in an extracurricular interscholastic activity which is a 23 contest in grades seven through twelve shall provide students 24 participating in such contests with any protective gear, 25 including but not limited to helmets and pads required for the 26 activity by law, by the rules for such contests, or by Iowa 27 high school athletic association or Iowa girls high school 28 athletic union guidelines. However, an individual student 29 is responsible for other protective gear that the individual 30 student needs but that is not required for participation in the 31 contest as provided in this subsection. 32 8. Use of general fund. 33 a. For school budget years beginning on or after July 1, 34 2017, the board of directors of a school district, by board 35 -4- LSB 1453HV (2) 87 je/jh/rj 4/ 8
H.F. 563 resolution, may transfer from the school district’s general 1 fund to the student activity fund an amount necessary for any 2 of the following: 3 (1) To purchase protective gear required by subsection 7. 4 (2) To employ or engage a licensed health care provider to 5 provide preventative and other medical services for students 6 during participation in any extracurricular interscholastic 7 activity. 8 b. The board of directors shall consider all available 9 cost-neutral options to pay for the activities described in 10 subsection 1, including but not limited to volunteers, in-kind 11 or other free services, and sponsorship by third parties. 12 Sec. 5. APPLICABILITY PROVISIONS. A person required to 13 complete training pursuant to section 280.13C, subsection 3, as 14 enacted by this division of this Act, has until July 1, 2018, 15 to initially complete such training. 16 Sec. 6. STATE MANDATE FUNDING SPECIFIED. In accordance 17 with section 25B.2, subsection 3, the state cost of requiring 18 compliance with any state mandate included in this division 19 of this Act shall be paid by a school district from state 20 school foundation aid received by the school district under 21 section 257.16. This specification of the payment of the state 22 cost shall be deemed to meet all of the state funding-related 23 requirements of section 25B.2, subsection 3, and no additional 24 state funding shall be necessary for the full implementation of 25 this division of this Act by and enforcement of this division 26 of this Act against all affected school districts. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 Division I of this bill provides that an applicant for a 31 coaching authorization or coaching endorsement issued by the 32 board of educational examiners and a person employed by a 33 school district as a coach must possess a valid certificate of 34 completion of a nationally recognized course in cardiopulmonary 35 -5- LSB 1453HV (2) 87 je/jh/rj 5/ 8
H.F. 563 resuscitation and use of an automated external defibrillator. 1 A person who possesses a valid teaching license with a 2 coaching endorsement or a coaching authorization issued by the 3 board prior to July 1, 2017, shall have until July 1, 2018, to 4 meet the requirements of the bill. 5 Division II of the bill strikes current Code section 280.13C 6 relating to concussion and brain injury policies and creates 7 new Code section 280.13C relating to the same subject. 8 The division requires the Iowa high school athletic 9 association (IHSAA) and the Iowa girls high school athletic 10 union (IGHSAU) to work together to develop training materials 11 and courses regarding concussions and brain injuries. The 12 division requires each coach or contest official to complete 13 such training at least every two years. The division requires 14 individuals required to complete training to submit proof of 15 such completion to the school board or authorities in charge 16 of the accredited nonpublic school within 30 days of such 17 completion. The division provides that a person required to 18 complete such training has until July 1, 2018, to initially 19 complete the training. 20 The division requires the IHSAA and the IGHSAU to work 21 together to distribute the centers for disease control and 22 prevention guidelines and other pertinent information to 23 inform and educate coaches, students, and the parents and 24 guardians of students of the risks, signs, symptoms, and 25 behaviors consistent with a concussion or brain injury. The 26 division requires each school district and nonpublic school to 27 annually provide to the parent or guardian of each student a 28 concussion and brain injury information sheet, as provided by 29 the IHSAA and the IGHSAU. The division requires the student 30 and the student’s parent or guardian to sign and return 31 the information sheet to the student’s school prior to the 32 student’s participation in any extracurricular interscholastic 33 activity for grades 7 through 12. 34 The division requires that a student be immediately removed 35 -6- LSB 1453HV (2) 87 je/jh/rj 6/ 8
H.F. 563 from participation in an extracurricular interscholastic 1 activity if the student’s coach, contest official, or licensed 2 health care provider observes signs, symptoms, or behaviors 3 consistent with a concussion or brain injury. 4 The division requires the IHSAA and the IGHSAU to work 5 together to develop a return-to-play protocol for a student’s 6 return to participation in an extracurricular interscholastic 7 activity after showing signs, symptoms, or behaviors consistent 8 with a concussion or brain injury. The division requires the 9 school board and the authorities in charge of each accredited 10 nonpublic school with enrolled students who participate in an 11 extracurricular interscholastic activity which is a contest in 12 grades 7 through 12 to adopt such protocols. 13 The division requires the school board and the authorities 14 in charge of each accredited nonpublic school with enrolled 15 students who participate in an extracurricular interscholastic 16 activity which is a contest in grades 7 through 12, for school 17 budget years beginning July 1, 2017, to provide students 18 participating in such contests with any protective gear 19 required for the activity by law, by the rules for such 20 contests, or by IHSAA or IGHSAU guidelines. The division 21 provides that an individual student is responsible for other 22 protective gear that the individual student needs but that is 23 not required for participation in the contest as provided in 24 the division. 25 The division permits a school board, by board resolution, to 26 transfer funds from the school district’s general fund to the 27 student activity fund for certain activities specified in the 28 division. The division requires the school board to consider 29 all available cost-neutral options to pay for such activities. 30 The division provides legislative findings. 31 The division may include a state mandate as defined in Code 32 section 25B.3. The division requires that the state cost of 33 any state mandate included in the bill be paid by a school 34 district from state school foundation aid received by the 35 -7- LSB 1453HV (2) 87 je/jh/rj 7/ 8
H.F. 563 school district under Code section 257.16. The specification 1 is deemed to constitute state compliance with any state mandate 2 funding-related requirements of Code section 25B.2.
