instructional
program
for
children
who
are
attending

defined
by
the
state
board
of
education

under
section
256.11
or
a
higher
grade
level
and
are
at
least

four
years
of
age
,
or
are
at
least
three
years
of
age
and

eligible
for
special
education
under
chapter
256B,
administered

by
any
of
the
following:

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
definition
of
child
care
for
13
purposes
of
regulation
by
the
department
of
human
services.

Under
current
law,
“child
care”
does
not
include
an
15
instructional
program
administered
by
a
school
system
for
16
children
who
are
attending
prekindergarten
and
are
at
least
17
four
years
of
age.
The
bill
also
excludes
an
instructional
18
program
for
children
who
are
at
least
three
years
of
age
and
19
eligible
for
special
education
under
Code
chapter
256B,
that
is
20
administered
by
a
school
system.
