H.F. 466 Section 1. Section 509.3, subsection 1, paragraph h, Code 1 2017, is amended to read as follows: 2 h. A provision that the insurer will permit continuation 3 of existing coverage or reenrollment in previously existing 4 coverage for an individual who meets the requirements of 5 section 513B.2, subsection 14 , paragraph “a” , “b” , “c” , “d” , or 6 “e” , and who is an unmarried a child of an insured or enrollee 7 who so elects, at least through the policy anniversary date 8 on or after until the date the child marries, ceases to be 9 a resident of this state, or attains the age of twenty-five 10 years old, whichever occurs first, or so long as the unmarried 11 child maintains full-time status as a student in an accredited 12 institution of postsecondary education twenty-six . 13 Sec. 2. Section 509A.13B, Code 2017, is amended to read as 14 follows: 15 509A.13B Coverage of children —— continuation or 16 reenrollment. 17 If a governing body, a county board of supervisors, or a 18 city council has procured accident or health care coverage for 19 its employees under this chapter , such coverage shall permit 20 continuation of existing coverage or reenrollment in previously 21 existing coverage for an individual who meets the requirements 22 of section 513B.2, subsection 14 , paragraph “a” , “b” , “c” , 23 “d” , or “e” , and who is an unmarried a child of an insured or 24 enrollee who so elects, at least through the policy anniversary 25 date on or after until the date the child marries, ceases to 26 be a resident of this state, or attains the age of twenty-five 27 years old, whichever occurs first, or so long as the unmarried 28 child maintains full-time status as a student in an accredited 29 institution of postsecondary education twenty-six . 30 Sec. 3. Section 514A.3B, subsection 2, Code 2017, is amended 31 to read as follows: 32 2. An insurer issuing an individual policy or contract 33 of accident and health insurance which provides coverage for 34 children of the insured shall permit continuation of existing 35 -1- LSB 1324HV (2) 87 av/rj 1/ 3
H.F. 466 coverage or reenrollment in previously existing coverage for 1 an individual who meets the requirements of section 513B.2, 2 subsection 14 , paragraph “a” , “b” , “c” , “d” , or “e” , and who is 3 an unmarried a child of an insured or enrollee who so elects, 4 at least through the policy anniversary date on or after until 5 the date the child marries, ceases to be a resident of this 6 state, or attains the age of twenty-five years old, whichever 7 occurs first, or so long as the unmarried child maintains 8 full-time status as a student in an accredited institution of 9 postsecondary education twenty-six . 10 Sec. 4. Section 514B.9A, Code 2017, is amended to read as 11 follows: 12 514B.9A Coverage of children —— continuation or reenrollment. 13 A health maintenance organization which provides health care 14 coverage pursuant to an individual or group health maintenance 15 organization contract regulated under this chapter for 16 children of an enrollee shall permit continuation of existing 17 coverage or reenrollment in previously existing coverage for 18 an individual who meets the requirements of section 513B.2, 19 subsection 14 , paragraph “a” , “b” , “c” , “d” , or “e” , and who 20 is an unmarried a child of an enrollee who so elects, at 21 least through the policy anniversary date on or after until 22 the date the child marries, ceases to be a resident of this 23 state, or attains the age of twenty-five years old, whichever 24 occurs first, or so long as the unmarried child maintains 25 full-time status as a student in an accredited institution of 26 postsecondary education twenty-six . 27 Sec. 5. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 28 immediate importance, takes effect upon enactment. 29 Sec. 6. APPLICABILITY. This Act applies to policies, 30 contracts, or plans of accident or health care coverage 31 delivered, issued for delivery, continued, or renewed in this 32 state, on or after January 1, 2018. 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -2- LSB 1324HV (2) 87 av/rj 2/ 3
H.F. 466 the explanation’s substance by the members of the general assembly. 1 This bill relates to continuation of or reenrollment of 2 certain dependents of enrollees in group, public employee, 3 individual, and health maintenance organization health care 4 coverage. The bill provides that a child of an enrollee who 5 so elects can continue or reenroll in the parent’s health care 6 coverage until the date the child attains the age of 26. This 7 provision is consistent with federal law concerning coverage 8 of adult children. 9 The bill deletes a provision that requires such health 10 care coverage to permit an unmarried child of an enrollee to 11 continue or reenroll in such coverage until the child ceases to 12 be a resident of this state or attains the age of 25 years old, 13 whichever occurs first, or so long as the unmarried child is a 14 full-time student in an accredited institution of postsecondary 15 education. 16 The bill is effective upon enactment. The provisions of 17 the bill are applicable to policies, contracts, or plans 18 of accident or health care coverage delivered, issued for 19 delivery, continued, or renewed in this state, on or after 20 January 1, 2018. 21 -3- LSB 1324HV (2) 87 av/rj 3/ 3
