1.
Section
321.384,
Code
2017,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
3.
Notwithstanding
subsection
1,
a
3
motor
vehicle
operating
upon
a
highway
within
the
state
that
4
is
equipped
with
automatic
headlamps
or
headlamps
lighted
5
by
default
shall
at
all
times
display
lighted
headlamps
as
6
provided
in
section
321.415.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
9
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
motor
vehicles
operating
on
a
highway
are
11
required
to
display
lighted
headlamps
at
any
time
from
sunset
12
to
sunrise,
and
at
such
other
times
when
conditions
such
as
13
fog,
snow,
sleet,
or
rain
provide
insufficient
lighting
to
14
render
clearly
discernible
persons
and
vehicles
on
the
highway
15
at
a
distance
of
500
feet
ahead.
16
This
bill
requires
motor
vehicles
operating
on
a
highway
17
that
are
equipped
with
automatic
headlamps
or
headlamps
lighted
18
by
default
to
display
lighted
headlamps
at
all
times.
By
19
operation
of
law,
a
violation
of
this
provision
is
punishable
20
by
a
scheduled
fine
of
$30.
