H.F. 409 Section 1. Section 602.8109, subsection 1, Code 2017, is 1 amended to read as follows: 2 1. A city or a county shall have the option to pay court 3 costs and other fees payable to the clerk of the district 4 court for services rendered upon receipt of a statement from 5 the clerk disclosing the amount due. upon any of the following 6 occurrences: 7 a. Upon the filing of a civil or criminal action or the 8 rendering of court services that require the payment of a fee 9 or costs. 10 b. Upon receipt of a statement from the clerk disclosing the 11 amount due. 12 c. Upon entry of judgment in a civil or criminal case in 13 district court if the city or county does not prevail in the 14 civil or criminal case. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill concerns the payment of court fees and other fees 19 to the clerk of the district court by a city or county. 20 The bill provides a city or county with the option to pay 21 court costs or fees when the court filing requiring the payment 22 occurs, upon receipt of a statement from the clerk disclosing 23 the amount due, or upon adjudication of the civil or criminal 24 case in district court if the city or county does not prevail 25 in the civil or criminal case.
