H.F. 383 Section 1. Section 272.9A, Code 2017, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4. A superintendent of a school district 3 shall not be considered to be in violation of the board’s 4 standards of professional conduct and ethics if the school 5 budget review committee denied the school district’s request 6 for a modified supplementary amount for a budget year and the 7 superintendent approves the school budget and requests the 8 school board’s authorization for the use of funds from the 9 school district’s cash reserve in an amount not to exceed the 10 district’s weighted enrollment multiplied by the difference 11 between the school district’s regular program district cost per 12 pupil and the highest regular program district cost per pupil 13 among all school districts in the state. 14 Sec. 2. RETROACTIVE APPLICABILITY. This Act applies 15 retroactively to actions taken by the superintendent of a 16 school district for school budget years beginning on or after 17 July 1, 2016. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill establishes that a superintendent of a school 22 district shall not be considered to be in violation of the 23 board of educational examiner’s standards of professional 24 conduct and ethics if the school budget review committee 25 denied the district’s request for a modified supplementary 26 amount for a budget year and the superintendent approves the 27 school budget and requests the school board’s authorization 28 for the use of funds from the school district’s cash reserve 29 in an amount not to exceed the district’s weighted enrollment 30 multiplied by the difference between the school district’s 31 regular program district cost per pupil and the highest regular 32 program district cost per pupil among all school districts in 33 the state. 34 The bill is retroactively applicable to actions taken by the 35 -1- LSB 2093YH (7) 87 kh/rj 1/ 2
